At this point is there anything else you can do as r4gards their behaviour?

Maybe a standards complaint to the SRA?

Show us the letter or go back to them and insist.

Sigh. Yes, send the sar off you were told to send off two weeks ago
Date of issue is required
Go online and ACKNOWLEDGE the claim. Do Not start the defence. Do not contest jurisdiction

Check mcol
See what it says
That's the first place to check. We can't tell you more than the actual court...

Indeed, ignoring the court claim form was stupid. Sorry, but it was. You could have gone to the GIVERNMENT WEBSITE on the form, entered the claim ref and seen it was genuine

Best you can do - and you must do this MONDAY - is call parking eye
Ask if they will agree to a set aside by consent , and you will pay all fees, draft the consent order (search) and pay the ccj in full.

Do not delay
If you do not of this this week, including getting the draft consent order signed by them, and the n244 filed with the court - the court could decide you did not act promptly and refuse your application.

No joke
This is your ONLY option
Your 2 is irrelevant. Completely and utterly irrelevant. You are so far past this stage it's laughable. The ONLY thing that can be done now is try to repair the credit file. Nothing more.

In your appeal state it did not contravene any listed terms
Require them to prove it was a commercial vehicle. You require all documents thy hold that prove this

Read other threads
You don't "get them off your back" that easily. You make yourself too tough a target for court.

I would state what was in those letters

You can then show it to court in support of your version
Include in your defence that as a response to your letter of x date on or about y date they cancelled the charge.

Of course they could still bring it up. The pap being followed or not doesn't alter what they can submit in their bundle. It's then up to the court to deal with.

Use the forum search. By post, restrict to 2018 onwards

You write back
Statin* on x date you sent a letter stating y, and on or around a date they confirmed the ticket was cancelled
You are concerned that their data handling is poor, as it has lost both those letters

If they were not compliant with pofa then state so.

Yes you state a bullet as to why you dispute
You're getting confused between a lba response and filing a defence to a claim.

Acknowledge online
Do not start the defence
Read other threads, is the obvious answer. Standing and signage are always challenged.

That's where your popla code would be

Chap - the byelaws control parking, meaning it's not relevant land. That's it.

They had 28 days to submit evidence so just about there now
Sounds like a system error. Message POPLA.

Whatever gave you that idea?

I said give the asessor a chance, and strip out that unecessary bits of it.
No NtD was served, so yuo dont need to talk about the NtD.

Is it really de minimis?
De minimis would be - there was a 20min parkgn time and the vehicle stayed 20min and 30 seconds.

...and the bit that shows that only "relevant land" gives rise to Keeper liability?

I hate that hugely long POFA non compliant section

Just strip it out to the NtK compliance. Dont bore the assessor.

You need to list exactly where in POFA "byelaws" means this is not relevant land
It is your strongest point

1) DO NOT PUT A SUMMARY OF YOUR DEFENCE

How many times

2) Just have a simple numbering. 1, 2, 3, 4. No mixuing of a, b, c and i, ii, iii etc

3) , (which incidentally was an untruth as I had not received any correspondence in two years.)
No it wasnt. They HAD sent various communications. Just delete.

3)
The Now famous Beavis judgement actually relied on good clear signage and a penalty amount that was also clear and obvious so that the consumer would be in no doubt as to the contract they were forming.
No.
"the Beavis judgement relied on clear signage and a parking charge amount that was clear and obvious ...."

Then include a PICTURE Of the Baevis sign,ps o you can illustrate the difference between this and the sign in the car park. But I would do this AFTER you get to the car park

Think of this as a timeline
WHy talk about Beavis and signs, when yuo havent yet seen a sign?

"I put it on record..."
erm, just say "Had I seen a clear and obvious sign stating charges apply, instead of the HI sign stating nothing about charges..."

HOw much was the final chance to pay from CEL? Thats one figure you did not include.
I woudl put dates in numeric form. Much easier to see
So give the actual date e.g. 01.04.2018

It isnt rash. Rash requires human intervention. There is no human intervention.

Beavis never argued de minimis, so not sure how you can decide this is indistinguishable from Beavis....
