Hi There,

parking charge stuck to the keepers car at the start of December 2017 for "Vehicle Owner/Driver Left site" Issued by UKPC
The registered keeper had not parked the car in this case.

Fortunately they've made a hash of it and mistook one of the numbers in the cars number plate for a letter, which is on the parking charge and all online photo evidence is under the wrong number plate on their website, which they haven't corrected as of the time of this post.

The driver then waited for a notice to keeper to be sent to the registered keeper.

They've just sent through today a Notice to keeper which the driver has been informed of and this is the only place the correct number plate has been stated.

Looked through a lot of discussions of which i have an idea of how i should approach but just didn't want to get the appeal wrong with this specific situation.

Hesitant to post dates just for traceability so let me know if you need them.

Please note that * paragraphs are ones that I'm considering leaving out as I'm trying to quash any attempts to reply/trying to hard biggrin.gif

"Dear UKPC,

I am the registered keeper of vehicle registration --- --- and I am in receipt of your ‘Notice to Keeper’ received --.--.---- regarding one of your invoices ref ---------. I require that you cancel this invoice as you have no cause to charge me or the driver.

Firstly the parking charge notice has stated that the number plate is --- --- which contradicts the recent invoice that states the number plate is in fact --- ---

With reference to Protection of Freedoms Act 2012 schedule 4: 8,2,c
The notice must—
state that a notice to driver relating to the specified period of parking has been given and repeat the information in that notice as required by paragraph 7(2)(b), © and (f);

*as UKPC is a third party parking company you would not have a record of whether the driver used the facilities.
And asking for a form of receipt from one of the stores available on site arrives at the conclusion that a customer is not able to browse whilst using the on site parking.*

*If you have an employee witness statement of the driver leaving the site then they as employees of UKPC have failed to mitigate the circumstance.*

PoFA 2012 sched 4: 8,2,c

As you have failed to comply with the provisions of PoFA, I am not liable for this charge and you should contact the driver. As you are fully aware, I am not required to name the driver and will not do so without an order from a court.

You should confirm cancellation of this charge forthwith or provide me with a POPLA code where I will arrange for you to be instructed to cancel it.

No thats fine. its a first appeal. It wont result in cancellation, 99% of the time, so spending time on it is a fools errand.
