So my sister is beside herself because she is disabled and has never been in a situation like this, she has recieved a letter from another drivers insurance and the police accusing of driving without due care an attention and failing to stop and exchange details after reversing and causing a small scratch on a bmw.
could anyone explain what the potential consequences are... points?? fine?? also a firm called pattison law said they could probably handle it for £700... is this around the right price??? does anyone know any motoring solicitors?? many thanks too anyone that can help |

One presumes at this time they are asking for the identity of the driver for the allegation? Hitting a stationary vehicle falls below the standard expected of a safe and competent driver.
The best case scenario is the Police leaves the matter with insurers to resolve. The worst case scenario is a prosecution - that offence carries a fine and 3 to 9 points. (But this would likely be at the lower end). A court prosecution would also include costs and surcharge. also a firm called pattison law said they could probably handle it for £700... is this around the right price??? does anyone know any motoring solicitors?? Depends on what 'handle it' means. At this time providing the driver identity is the next step and see how they react. -------------------- RK=Registered Keeper, OP=Original Poster (You!), CoFP=Conditional Offer of Fixed Penalty, NtK=Notice to Keeper, NtD=Notice to Driver
PoFA=Protection of Freedoms Act, SAC=Safety Awareness Course, NIP=Notice of Intended Prosecution, ADR=Alternative Dispute Resolution PPC=Private Parking Company, LBCCC=Letter Before County Court Claim, PII=Personally Identifiable Information, SAR=Subject Access Request Private Parking - remember, they just want your money and will say almost anything to get it. |
