Parking passed double yellows

Hi,

I parked passed some double yellows and in all honesty thought it was OK! The PCN on my windscreen digested otherwise. Do I have a case?

I’ll try an upload a photo later.

Basically, no wheel or overhanging part of the car was on a yellow line but, just on a grass siding next to the lines. There’s a slight break in the line too.

Any thoughts appreciated

On the face of it, you are bang to rights on the contravention, but let's see the PCN etc. as requested by Stamfordman - edit out the PCN No. & Reg. No., but leave location in.

pretty much bang to rights but let's see the street view location as there may be a case for usual use as a parking space.

Its right at the base of Catbells in the lake district near Keswick, its used as a parking place every day!

I would challenge this as it's clearly used as a regular off road parking place. Councils often do a blitz like this but should really issue warnings and enact a specific ban on verge parking if they want to stop it.

From your assertion that this place is used "every day", I presume you're a local resident. Have you been parking here a lot, and have you ever received a PCN at this location before?
If the answers are "yes" and "no" respectively, then you may be able to claim "Legitimate Expectation" and you need to write to the Council along the lines of ' I have been parking at this location on a regular basis for the past xx years and have never received a PCN before. This being the case, I honestly believed that parking was permitted'.
This will only work once - park there again and any PCN issued will be valid.

post your challenge. I wonder re the statement that its a narrow road and where you parked could be used as a passing point. Does this mean its part of the carriageway? If so then the DYL are in the wrong place

I didn’t save the challenge letter I sent.

It’s a verge on the side of the road, not a passing place or part of the carriageway
