Help Parking ticket parked without valid permit or ticket

Dear All

I got this parking charge last month originally it would have been £15 I wanted to pay it but then all the coronavirus issue came out and there was a panic as I'm a student living away from home I had to quickly gather all my belongings and head home now that I'm home I received this letter and remember I forgot to pay for this ticket. I was parked outside of the university campus which is part of the university but only to permit holders I can see this is a private company is there anything I can do I dont have much money because of costs etc. I was told by others signs aren't clear and I only recently got the car so I was not used to parking zones.

please someone help

EDIT that post please, you refer to what 'the driver' did, no I, we, they, he or even the dog. NEVER give away driver ID unless you are sure it's beneficial to do so.

You will deal with this as the keeper of the vehicle.

Date of event?
Are you the registered keeper? If not who is?
Are you at the registered keeper address (as on the V5c registration document) such that you'll get any Notice to Keeper?

Photo/scan of the ticket please.

Hopefully there was no 'I was the driver' box involved when accessing the online photo's?

Dear Sirs,

I have received your Notice to Keeper xxxxx for vehicle VRM xxxx

You have failed to comply with the requirements of Schedule 4 of The Protection Of Freedoms Act 2012 namely, but not limited to, failing to give notice of keeper liability in the format as prescribed by section 8 (2) (f) of the Act.

In addition you have failed to specify the period of parking as required by 8 (2) (a), failed to state that the driver is liable as required by 8 (2) (b),

You cannot, therefore, transfer liability for the alleged charge from the driver at the time to me, the keeper.

May I take this opportunity to remind you that the keeper can only be held liable for the amount on the original Notice to Keeper, as specified under POFA 4 (5) so that would be £60 rather than the £120 you are attempting to claim in your later letter.

There is no legal requirement to name the driver at the time and I will not be doing so.

I do not expect to hear from you again, or your debt collectors, except to confirm that no further action will be taken on this matter and my personal details have been removed from your records.

Send your appeal and when rejected don't appeal the the IAS. Wait for a letter before claim if it comes

Hi there Ostell

thank you very much for your detailed response on how to deal with this case.

so from your response i gathered that i forward this correctly in hope that the ticket is then voided because of failure to comply with these rules mentioned and that they could follow up with a Independent Appeals Service but when this arrives do not reply/appeal but wait for a letter which should come before the claim.

also you noted £60 - £120 but the original figures were £15 - then £60. was this a template which you had given and i need to correct any conflicting information.

Yes, you correct any info. SHow us your corrections
Your timeline is right; they SHOUDL cancel, because you have no liabilty in this matter, but if they did that they dont get paid. So, you avoid the IAS like the plague and ONLY bother to engage more if you get
- a letter before claim
and/or
- a claim form
You do NOT ignore thsse.

What did the original NTK say about amount due and what does POFA 4 (5) say?

No doubt this £120 includes the usual £60 debt recovery charge, which is not allowed and should be an abuse of process at court.
Also, you said in your original post the driver was parked in a permit only area.

We asked for photos of signage previously as this could be of a forbidding nature.

Could the OP ask the moderator to be able to edit the original post?
