Can`t ascertain who was driving at the time

Hi guys. it`s been quite a few years since I was on here and I hope your all well. Licence clean for about 8 years!
In a nutshell I was informed this morning of an NIP with the mini I drive for work. date of incident 25/6/18, the car is on permanent hire so the NIP went to the RK 1st and then to the company I work for on the 24th of the 7th (Date on the NIP sent to the company). There are around 8 of us which use this vehicle but mostly myself and going back that far we have no idea who was driving at the time and you can`t make out who it was at all from the photo`s, it`s just a blur.
It`s now 27 days since they received the notice but I was only informed today. What do I/we do? (do they still send a reminder out?)

I would not chance it though, if someone opens the letter on the 24th they might make a point of printing off the paperwork before heading home

That's my fear

Somebody alert enough to look out for replies slid through at the last minute before the Christmas break for this very reason

I like the idea of the New Year card
If the OP feels really lucky he could use it for the reply but he'd better make sure he has a copy, certificate of sending and a witness

I like that idea, just provide all the necessary details (name, address, licence number etc) in the card itself, there's no need to use their form providing all the necessary information is included

The 28 days begins on the day the notice is served, not the day it's sent

The Interpretation Act says that a First Class letter is delivered two business days after it's posted
The police will therefore assume yours arrived on 6th December and the deadline for your reply to be received is 3rd January

Working backwards, you must send your reply no later than 31 December (New Years Day is not classed as a working day)
Personally I would avoid any risk of it arriving late

The deadline to prosecute you expires on 24th December so posting it on any day that week will do
You must however send it from a Post Office so you can ask for a free certificate of sending

From a legal point of view, only the first letter to the registered keeper is a NIP as required by the RTOA however in plain English the later ones are a Notice and they do tell you there is an intent to prosecute. Most forces use the exact same paperwork for all S172 requests so it will say NIP on it. I guess it could say Elephant on it but it wouldn’t make it one biggrin.gif .

I’d post first class on the 24th with proof of posting, that’s 100% safe for you and stands little chance of not arriving in time.

So what happens after that date, I take it they`ll be unaware I know of the 6 month rule and will still try it on?

Yes, it’s quite common for them to send a CoFP that you would be safe to ignore.

I`ve had a clean licence for maybe 10 years no, had 1 SAC a few years back but been a good boy since.
After 4 Outbacks i`m now back with a XC60 diesel. 20 MPG was getting a bit pricey but I do miss the old 3 litre flat 6 at times.

Hence the only part joking suggestions of the half anniversary card that makes clear you know of the six month rule

We've seen a couple of threads where late COFPs have been sent and even reminders when they've been ignored

+1, you don't want to run any unnecessary risks so I would send it on the 24th. There is nothing to be gained in waiting any longer than that, sure if it arrives late you should have irrefutable proof it was sent on time (you could always film yourself posting it at the post office if you're as paranoid as me and don't want to rely just on the certificate of posting), but I'm sure that having to prove you sent it on time is hassle you'd rather do without.

It times out on the 25th so If I send it on the 24th it`s got no chance of arriving on the 25th right?
