Hi everyone,

This is my first post on this forum, I really need some advice.

I received a PCN for stopping in a YBJ. I've requested copies of the video but still waiting on it to arrive. I will update my post once its received.

This is my fist YBJ PCN in my 11 years of driving so I am really disappointed.

Any help would be greatly appreciated.

My car is the blue Clio.

On the day in question there were an accident on the North Circular, it was raining heavy as you can see from the images you cannot see anyone inside the car.

I got lost on the way back home and panic a bit. You can see that my signal was on to turn right on the YBJ but I couldnt see clearly ahead because the traffic light was way ahead.

Cars still managed to passed behind me and I wasnt 100% in the YBJ.

I really would like to know if I can appeal this or do I have to cut my loss?

Images will be online if you log into TFL PCN challenge page. But video is key.

If you are going to appeal we advise sticking to deadlines regardless of whether the video comes in time.

Post all pages of the PCN. Use a site such as Imgur or Flickr.

Thank you Stamfordman, I have uploaded 2 pages of the PCN. I will look for further images from TFL site and upload. The 2 images they sent me with the PCN none shows my number plate clearly so I dont know if this any grounds for appeal.

I have requested a video from https://www.viewmypcn.co.uk but they advised me that its busy times so may take sometime.

The first 2 pics look to show you stationary for 5 secs half in the box - I think the contravention is made out and you may be better off paying the discount here unless there are faults with the PCN.

It's best not to get into a mess with TFL on process.

Thank you for replying.

There was mitigating circumstances I had a disable passenger with a blue badge who was my priority in terms of stopping/breaking, an accident ahead which also caused built up traffic and bad whether. Is any of these any grounds to appeal?

Also, do you know if I appeal it within the 14 days do they still give me the opportunity to pay at the discount rate after they looked into it?

Yes, if you challenge early they will reoffer the discount. You should do it online and keep a copy of the challenge.

I'm afraid I can't see grounds for mitigation really from what you say - you should be driving according to the conditions and if there was any danger to a passenger they shouldn't have been in the car.

Thanks alot again for replying. Yes I completely agree with you but as you know sometimes you have to make a judgement call within seconds.

From what I can see from the images I was in the YBJ for less than 30 seconds and cars still passed without any obstructions.

I am going to try my luck and appeal it let's see what they come back with.

Hopefully the video will be sent soon so I can look at that too.

I've requested a copy of the video, TfL advised me that it will be sent out via the post and the PCN will be put on hold for 14 days until the video arrives.

Can you tell me please if there is any error on my PCN or the regulations on the junction box which gives grounds to appeal?

For example does the junction boxes need to be touching the curbs?

I saw another post yesterday someone mentioned when a PCN states " that if the penalty is not paid or representations made before the end of the 28 day period (this is date of notice) then the penalty may increase and they may serve a charge certificate"

This is wrong they can only serve a charge certificate after 28 days beginning with the date of service of the PCN. In this case that would be four days later.

I cannot find fault in TfL PCN's anymore, and the box looks compliant. TBH the discount looks a good option

Strictly speaking, the YBJ isn't on the North Circular Road at all, as the mainline is in an underpass at that point, but rather at the junction of Silver Street (or possibly Sterling Way, depending on your point of view) and Victoria Road.

+1. According to my GSV, the YBJ is at the junction of Silver and Victoria, you must ignore the pairs of 'North Circular Roads', they're there simply to indicate that the separate carriageways of the NCR run under this junction.

Looking at this another way, unless Victoria Road is a defined junction with NCR or GLA side road then I cannot see that the location is correct.

As regards side road, your test today OP is to decipher the meaning of items 55 and 62 of this:

Hi,

Thanks for looking into this for me.

You are correct. I've checked aswell and the YBJ is on Silver Street and Victoria Road. Although the PCN is labelled as North Circular and Victoria Road.

I cannot accept any liability until I see the video but I am thinking of challenging it on the basis that I did not block traffic cos traffic was flowing as you can see from the images.

I don't know what they expect drivers to do sit and wait so more traffic can build of or drive when its safe to do so. From what I recall I stopped before the YBJ and when traffic started to move I drove off but my visibility ahead was not clear and the lights changed quickly causing the cars ahead to stop.

The two cars infront of my actually overtake me cos I hesitated to drive off.

I have no idea of any of this gives me grounds to challenge this PCN.

Hi Barry S,
I came off Silver St on to Victoria Road and continued to Sterling Way. The North Circular Road is way ahead.

So do I have grounds to appeal on the basis of incorrect location? Aslo is there an example of what I can put in my appeal please?
