hey all, the driver received the attached notice today , not sure it is legal any help greatly received?? thanks

Edit so that the identity of the driver cannot be inferred. Use " the driver....." etc. Take down the picture, edit out identifying details and repist

Did the driver see any signs in the area?

The keeper appeals this so that the appeal arrives on day 26. Complain about the lack of signage/unclear signage. Aim is to get them to respond to you without issuing a Notice to Keeper within 56 days or not apply to the DVLA for keeper details. Either is a POFA fail and if they do not know the driver they are stuck

very small sign behind an alcove. it says on the pcn appeals to arrive within 21 days. thanks

OK, so that it arrives on day 19. Was the sign visible and readable when oarking? What did it say?

What was the driver supposed to do - pay for parking or register the car on a keypad ?

It's unusual to find a parking company at a hotel having an operative on the ground instead of using ANPR

the sign was visible, it said, 'attention private land' and a load of small writing, measured 2ft x 1 foot, 1 sign only and hidden behindhand an alcove, not clear or prominent. the ambassador hotel been closed of several years. no instruction to register for parking or to pay.

the 21 days expires next weekend. the pcn instructs an appeal to be lodged via post or email. if its within 14 days and rejected reduced rate of £60 is payable. if appeal within 15-21 days and rejected full amount £100 is due. the notice says i must provide full name and address.the vrn, PCN number and reasons for contesting.. any advice?

In your appeal make a slight alteration to your address by a digit, such as Beech Road instead of Beach Road to see if they access DVLA for your details.

The sign is a prohibiting sign. Here's some text I saved about this:

The signage in the car park is of a “forbidding” nature. It is limited to cars displaying a valid permit only and therefore the terms cannot apply to cars without a permit because the signage does not offer an invitation to park on certain terms. The terms are forbidding. This means that there was never a contractual relationship. I refer you to the following case law: PCM-UK v Bull et all B4GF26K6 [2016], UKPC v Masterson B4GF26K6[2016], Horizon Parking v Mr J C5GF17X2 [2016] – In all three of these cases the signage was found to be forbidding and thus only a trespass had occurred and would be a matter for the landowner.

so a 'notice to keeper' has been issued.
an invitation to either pay OR notify name of the driver and current address within 28 days or they have the right to recover ,

any1 any suggestions??

Yes, post up the NTK, suitably redacted but leave dates, for all to look at. Was the address the same as the modified address you used in your appeal or is it the address on the V5? If you did not modify your address then email to DVLA requesting information about who requested your details between the date of the event and the date of the NTK SubjectAccess.Requests@dvla.gov.uk
