Hi guys, I’m after some help if possible please, we received a fine through the post today from the peel centre Stockport, the driver was adamant they paid and after searching there car they found the pay ticket. Upon further inspection that the machine may be faulty. Is there any hope in winning this? I’m just hoping somebody had had some experience with similar and has got good news.
Any help would be much appreciated Thanks guys This post has been edited by Speaky2: Sun, 15 Sep 2019 - 17:42 |

Chances of a successful appeal ?
Almost zero Chances of winning in court ? Very high I would make a challenge as the keeper Under no circumstances identify the driver This will demonstrate to a court later that you acted reasonably Do not make the second appeal to the IAS when it's offered It's a kangaroo court and you have no chance Just file and ignore all further correspondence short of a Letter Before Claim |

The Parking was paid for so there is no loss to them.
These machines can be faulty or sticky key pads. Also edit your post and remove anything that may identify who drove the vehicle, refer only to "the driver" did this or that. |

Wasn't there at least one claim where the judge ruled that the registration number error was the result of a communication fault between the keypad at the Peel Centre and the Excel base ?

I think that Excel had their marching orders from The Peel Centre Stockport a couple of months ago.

The Parking was paid for so there is no loss to them. I doubt they actually collect the tariff themselves - which is why they are so interested in their charges... (It's their only income) ...but I agree there's a good argument that Beavis could be disengaged and it could be considered an unenforceable penalty. -------------------- RK=Registered Keeper, OP=Original Poster (You!), CoFP=Conditional Offer of Fixed Penalty, NtK=Notice to Keeper, NtD=Notice to Driver

Cheers guys, we’ve appealed and let’s see what happens next To whom did you appeal? Did you miss my earlier (possibly important) question? I think that Excel had their marching orders from The Peel Centre Stockport a couple of months ago.

So when was the "offence" and what dates are on the letter and when was it received? Perhaps post up the redacted NTK
I'm thinking along the lines that if they have been thrown off they are trying g to make money from out of date events. |
