Good Morning All,
The driver has received this PCN (please see attached). There is a camera which has taken the picture while the vehicle has entered and when the vehicle was leaving, there is only the number plate on the PCN and not the whole picture of the car. Please help! Kind Regards This post has been edited by Sonu rocks: Fri, 13 Sep 2019 - 10:52 |

Edit your posts so that a possible driver cannot be inferred
Dear Sirs, I have just received your Notice to Keeper xxxxx for vehicle VRM xxxx You have failed to comply with the requirements of Schedule 4 of The Protection Of Freedoms Act 2012 namely, but not limited to, failing to give the invitation to keeper in the format prescribed by section 9 (2) (e) of the Act. You cannot, therefore, transfer liability for the alleged charge from the driver at the time to me, the keeper. There is no legal requirement to name the driver at the time and I will not be doing so. I do not expect to hear from you again, or your debt collectors, except to confirm that no further action will be taken on this matter and my personal details have been removed from your records. Yours etc First class post with free certificate of posting from a post office They will reject but POPLA should be successful This post has been edited by ostell: Fri, 13 Sep 2019 - 13:58 |

Start compiling your POPLA appeal.
Key point being lack of keeper liability. They’ll probably not contest... They are not in the business of accepting appeals - no income in that... -------------------- RK=Registered Keeper, OP=Original Poster (You!), CoFP=Conditional Offer of Fixed Penalty, NtK=Notice to Keeper, NtD=Notice to Driver

Sorry, so as I understand I should write the same letter to POPLA as follows:
Dear Sirs, I had received the Notice to Keeper xxxxx for vehicle VRM xxxx from Euro Car Parks dated ...... They have failed to comply with the requirements of Schedule 4 of The Protection Of Freedoms Act 2012 namely, but not limited to, failed to give the invitation to keeper in the format prescribed by section 9 (2) (e) of the Act. They cannot, therefore, transfer liability for the alleged charge from the driver at the time to me, the keeper. Yours etc Please let me know if my understanding is correct. |

You write to POPLA itemising ALL the POFA fails, question there right to issue charges, request the provide a copy of their contract and a witness statement saying it exists is insufficient

You MUST - MUST - read other POPLA appeals from 2019. DONT do this solo. |
