black box insurance - about to have policy cancelled by insurer

Hi everyone

my daughter has received notification from her insurer (she has a black box) that they are going to cancel her policy due to excessive speeding in 7 days time.

Obviously if she has her insurance cancelled it will make it much more expensive to get insurance in the future.

I was wondering what the situation was legally if she called up and cancelled the insurance herself before their cancellation takes effect. Will it then be the case that as she has cancelled the policy she would not need to declare this when seeking new insurance or am I just clutching at straws?!

I don't want her to do anything illegal - just wondering if the scenario above was possible and legal?

Does the notification say that they intend to cancel or that they have cancelled and that takes effect in 7 days.

She has had the insurance cancelled, and they have given her seven days notice of it due to the practicalities that she cannot have it cancelled whilst driving. If she cancels it means nothing more than both parties have cancelled.

If unsure call up a prospective insurer and ask.

someone being evicted in 30 days remains a tenant until that date arrives ....Re this case .You could argue that it hasn't yet been cancelled and won't be until "that date"

TO OP... What does the policy and or Black Box T&Cs say about what might happen re things such as speeding. If everyone had a B.B. there would be policies getting cancelled all over the place. Talk about Big Brother!!!

Check the data, I know someone with this issue, turns out they were on a 60 limit road right next to a 30 and the BB inadvertently thought the were speeding on the 30, if you can show them there equipment is faulty they may overturn the decision (as it could create a claim against them). If she was genuinely soeeding that excessively then a private word with her is possibly in order.

The issue is not what her current insurance company thinks, but what the insurance company who she next applies for thinks.

I work for a company that is involved with this sort of thing, and can confirm what Rookie says, sometimes the GPS of the tracking isn't 100% accurate, and you can get pinged as being on one road near a much faster one that you were actually on. One incident wouldn't be enough to trigger a severe driving score plummet, it would have to be a continual problem over many journeys for this to happen.

@OP - had your daughter received any sort of communication prior to the cancellation notice about speeding? Having access to the systems that display insurance company communications, I can often see if a driver has been warned in regards to certain infractions. Quite often multiple warnings will then trigger an insurance cancellation.

Hi. Having spoken to a couple of insurers they have provided quotes based on the fact that she has had a policy cancelled that are actually cheaper than when the insurance was taken out last year. So luckily it looks like she can keep on driving!

They may think it a bit strange in a Picanto (or any other first time driver car) but computer will simply be checking against speed limit.
