Hello everyone, I need help for once.
I knew from their online system that Southwark sent a Notice of Rejection for a moving traffic PCN on 28 October 2020 which the registered keeper, for whom I made the representations, didn't receive. I asked Southwark to send me a copy of it and they have replied saying they sent it on 28 October and my chocies are now to either pay or make an Appeal to the tribunal. Unhelpfully they didn't include a copy of the missing Notice of Rejection so I can't make an Appeal on line, which is quicker, without the verification code and I don't want to wait another 12 days for Southwark to respond especially as they say they cannot enter into further correspondence (blog to follow about their behaviour). I know it will start 72J0 but what I need are the final two numbers. Anyone got a NoR for Southwark for that date (or any other around that time as the last two numbers might not vary much?). Why mess about with this - just let it run to the order for recovery and then it will get sent to the tribunal anyway.

I agree. Mr. M, this is not about what you know, which because it is extensive cannot see the matter from the perspective of the owner, it's about the owner. IMO, the owner is obliged to wait until they have a NOR in their hands, not just a code. After all, how could the NOR be examined for reasoning/compliance without having it in one's possession? Anyway, you're outside the 28-day period so what would the adj make of a reason for lateness which amounted to 'Didn't receive the NOR'. Confusion could reign. IMO, wait, with the caveat that notwithstanding the disproportionate number of OPs here who claim to not have received notices (but then they're hardly a representative sample) mail does not go missing in normal circumstances. So, if they did not receive the NOR then they should think why and could a CC /OfR also go missing? |

I prefer sooner rather than later for getting to the tribunal. The odd thing is that as well as the letter to the registered keeper the copy of it which was supposedly sent to their email also did not arrive and I can be sure it didn't as it was an email address that I control.
I'll just use the post for the Appeal, today is day 29 & I am pretty sure that up to 7 days late the tribunal just put Appeals into the system. The formal reps were that the moving traffic PCN said a charge certificate could be issued 28 days after the date of the PCN so I don't really care what the council's answer is, I will plough on. (and yes they did say issued when they meant served). IIRC the last two digits are numeric, so trying the 100 possible combinations would be quicker than printing off the appeal and walking to the post office.

Follow up.
The email sent by Southwark didn't include a copy of the missing Notice of Rejection but the posted copy did and eventually the person I am helping sent it on. The code, for those who might be interested, was 72J010 which tells me the NoR was drafted on 28 October but not sent until the 29th because the first two numbers of the code + the date of the letter always = 100. I finally got an Appeal started on line on 7 December and explained the reason for the lateness which the tribunal has accepted and so I have saved myself the faff of having to go through the TEC process. Is this something you worked out or is there any published confirmation of this? I don't know that adjudicators would take our word for it but we've seen more than one case where the date of postage of the notice is, let's say, suspicious.
