What is the name of the Constabulary? - Date of the offence: - June 2018 Date of the NIP: - 75 days after the offence Date you received the NIP: - 76 days after the offence Location of offence (exact location as it appears on the NIP: important): - A40 North Way Oxford Was the NIP addressed to you? - Yes Was the NIP sent by first class post, second class or recorded delivery? - First If your are not the Registered Keeper, what is your relationship to the vehicle? - Company car How many current points do you have? - 3 Provide a description of events (if you know what happened) telling us as much about the incident as possible - some things that may seem trivial to you may be important, so don't leave anything out. Please do not post personal details for obvious reasons - Driving on dual carriageway with the flow of traffic saw van and looked at spee, 35, thought thats ok its 40 but it was 30. Busy road on inside lane with other traffic. NIP Wizard Responses These were the responses used by the Wizard to arrive at its recommendation: Have you received a NIP? - Yes Are you the Registered Keeper of the vehicle concerned (is your name and address on the V5/V5C)? - No Is the NIP addressed to you personally? - Yes Although you are not the Registered Keeper, were you the keeper of the vehicle concerned (the person normally responsible for it) at the time of the alleged offence? - No As you were not responsible for the vehicle, somebody else has named you as the driver. Were you driving? - Yes Which country did the alleged offence take place in? - England NIP Wizard Recommendation Based on these responses the Wizard suggested that this course of action should be considered:

The 14 day time limit only applies to the first NIP (which is the only one required by law) and presumably that was sent to the registered keeper, not you.

...and have 6 months to prosecute. So plenty of time.

Thanks for the replies. TVP say the first NIP went to the owners in 5 days so they are in date. I did speed awareness 1st Oct 2015 so going to be very tight? Can’t remember exactly when that offence was but it wasn’t that much before then.

The calculation is offence date to offence date (or rather should be as we’ve recently seen one where the force don’t appear to know what the published criteria are) so how do the two offence dates stack up? -------------------- There is no such thing as a law abiding motorist, just those who have been scammed and those yet to be scammed!
