Recieved nip but not the s172 part

Hi,
I recieved a nip in the post on 26.04.18 for undue care. However I still have not recieve the S172 asking for drivers details. Is this normal? This is really worrying me as I dont want to be procecuted for not returning drivers details as well.

For undue care? Surely that would be a good thing.

It's not normal no, usually the non 'sausage machine' (speeding and red light camera) actions are a bit flaky but not usually that flaky! You could write a short letter acknowledging receipt of a NIP and noting there was no S172 request enclosed.

Thank you for your quick reply.
I am hoping its a good thing.
I went to my local police station and spoke to an officer regarding my concerns. She disapeared for a bit and on return said i would brobably get a letter in a couple of week for speeding. That was 3 months ago.

What happened in the run up to the offence? Did you get pulled over for it or was this the first you heard about it?

I was not pulled at the time.
To be honest I got nobody to blame but myself.
I bit to sombody elses driving and retaliated by cutting her up.
Not my finest moment.
I don't know if i was reported or caught on dash cam
I'm not contesting this or looking for excuses or a way out. I'm just concerned about the s172 as i'm in enough trouble as it is

But surely they have to establish who the driver was first ..did you tell them at any point who the driver was?

Sounds like she looked at the wrong case, plus like most front desk staff doesn't really know what she was talking about.

Does sound like 'Without due care and attention' or inconsiderate, dangerous would have been a possibility but much much harder to prove it was that bad.

It may have just been the other driver as a witness or with a dashcam.

As its now 3 months ago there is little you can do but sit and wait it out, as that is rather a crucial detail you missed, is there anything else you haven't told us that may be as relevant?

Now i have 5 minutes i will try and go into some more detail.

The offence occurred on the 24.4.18 I was not stopped or spoken to at anytime.
2 days later 26.4.18 i recieved nip through the post. The nip itself is dated the 24th so written up the same day as the offence.
There was no s172 included with nip.

Several days later I enquired at local police station about missing s172. No joy.

Several weeks ago I rang 101 and explained the situation which the officer seems suprised at. As I have no ref number just an officers name and number they tried putting me through to the officer named but went to answer machine. I left message but still have had no response.

I have searched for hours to see if this as happened to anyone else without luck.

This issue is really giving me sleepless nights and I don't thnk I can cope with a failure to furnish charge as well.

What exactly do you mean by "there was no s172". Do you mean that there was no stated requirement to provide the driver's details, or just that there was no form provided to do so?
There is no such thing as an s172, merely things related to s. 172 of the Road Traffic Act 1988.

Most NIP/ 172 requests will be generated by a central office following speeding, red light offences, TOR's etc....... They will be used to the process.

If the evidence against the OP has come via a member of the public this may be being dealt with by a local officer who will not be that proficient in RTA matters, they may have neglected to consider that the RK is not always the driver.

OP - Do you know where the officer who is dealing with the case is based?

Whilst I would not suggest it is the norm there may be instances where paperwork gets filed as too hard to do in a big green bin. I would have expected the officer to invite you in to the Police Station to be interviewed regarding the allegation fairly soon after issuing the NIP, there doesn't seem to be any reason to delay this?

As has been said, there doesn't have to be a form, just a request, perhaps scan/photo the NIP and post (after redacting personal details).
