Parking badly in free car park

Hi there,

Someone parked my wife’s car in a free car park. You can see from the photos that the car next to her was over two bays so when she parked next to it she wasn’t in her bay either. It looks like there was no longer room for another car to park between her and a yellow hashed area.




Obviously the accusation of “not parked correctly within the markings of the bay or space” are accurate. Just wondering if there are grounds for appeal eg the charge isn’t justified in a free car park.

The only other thing is that there are 6 photos all time stamped at exactly the same time down to the second! That would mean that the time stamp wasn’t accurate so can we be expected to know who parked it?!

Any positive thoughts would be appreciated. If it’s a case of “it’s parked badly so just pay up”, feel free to say so politely!..

Post redacted pictures of both sides of the pcn and pictures of the signage on site too, hosted on postimg or imgbb or a similar hosting site and add links

We need to see the paperwork first, plus ideally the signs prese at Brent Cross

The fact that it is a free car park does not mean that there is no harm caused, or that the charge is not commercially justified.

As a quick social comment, if a driver cannot park entirely in a particular bay because the car in the next bay is also in that bay, unless there are no empty spaces, why do drivers feel the need to follow suit? If just one twassock parks in 2 bays, that loses a bay for the duration of their stay. If everyone else follows suit, a bay is lost for the whole day.
N.B. If the subsequent drivers manage to park close enough that the original twassock can't open the driver's door, that would be a good answer.

There are many things that might be right or wrong with the signage, the ticket(s), etc., but currently we have no way of knowing.

I don’t disagree with the issues or consequences of the standard of parking. But this is the driver’s 4th ticket this year (two for stopping on yellow grid in the same place and 1 for forgetting to pay and display) and I could do without the extra expense!

PCN attached with the parking companies sign photo. It doesn’t specify which car park it took place in so I haven’t been able to take my own photo of the sign…

It says Brent Cross car park, Brent Cross shopping centre, Hendon, London., NW4 3FP

The NTK PCN appears to be compliant with pofa, so the keeper may well be liable for the actions of the driver

I would say that all private parking signs mention parking within the bay markings, so as this case is about the breach of contract in not doing so, plus the compliance with pofa AFAIK, I don't see any way of the keeper winning this case

They can name the driver and I don't think that the driver could win any appeal either

UKPC do issue court claims for non payment, they have 6 years to do so

Sometimes, if it looks like a duck. Etc
