Hi - new on here and as expected have a question around the well debated yellow box junction in Cricklewood Lane NW2.
I received the attached PCN and frankly I would like to challenge it. My view is that the box extends further from the junction it should be protecting, there is traffic so I'm not blocking anyone and thirdly I thought I had cleared it. Look forward to your advice. Many thanks |

some flaws in the last page that might win for you. They time for action is extended by one day they cannot do this. They state that to appeal by post you must telephone them to request the form, this truncates the time you have to appeal by the time it takes them to act and must be prejudicial -------------------- All advice is given freely. So are you of the opinion I should fight it further? You can fight it at the tribunal but to have any credibility, you would need to submit the appeal by post. We cannot guarantee success but it's clearly arguable that the appeal form should be provided with the notice of rejection. It's a double or nothing gamble whether the tribunal would allow the appeal, though in principle it should. Interestingly the tribunal website indicates at https://www.londontribunals.gov.uk/eat/appe...ocess-explained that: A Notice of Appeal form should be sent by the enforcement authority with their Notice of Rejection. If this form is not enclosed, the authority should be contacted to obtain one. IMO the website refers more to where the form has not been included due to an administrative error, rather than due to a deliberate decision not to include it.
