New driver caught speeding, Young driver passed test 3 weeks ago caught doing 86 in a 60

Looking for advice , my son has been caught speeding doing 86 in a 60 ( convienant that it was 86 and not 85) he has only had his full licence three weeks . Got caught in wales on A470 cam Certis Dolgellau . He has received a NIP . What do we do next ? Will he have his licence revoked ?

This speed will require a court appearance, the sentence (if pleading/found guilty) is 4-6 points and a fine or a possible disqualification.

They won't disqualify, as this would avoid the New Drivers Legislation.

If he gets 6 points, the DVLA will write to him giving notice of revocation of his licence. Then he applies for a new provisional licence, and arranges for another test.


What happens now is whoever is the registered keeper signs returns the form naming him as the driver, if it isn't his car he then gets his own form to fill in sign and return.

Court proceedings will then commence within 6 months, which may take upto 7 months to actually start.

When the NIP was sent out it would have just been to the keeper on the V5.. They wouldn't have known who committed the offence or how long they held a licence.

Or are you suggesting that they massaged the alleged speed to prompt a court appearance?

He will have to hope the Mag's award 5 points instead of 6.

Insurance may be an issue afterwards mind.

I don’t condone what he has done and he will have to learn the hard way of licence gets revoked . I’m hoping he gets 4 points and has to be really careful . He will fill the form in as he was driving . Is it worth getting a solicitor or just go to court . New to all this .

Not worth a solicitor for a guilty plea.

If he got caught at that speed within 3 weeks of passing I wouldn’t be optimistic about him getting through two years with no other points at all, he may be better off getting the revocation out of the way now perhaps?

Oh yes , he has brown told that he needs to watch his speed at all times! He knows full well that he is pushing a fine line now . He has now learnt the hard way already !

Hopefully he has learnt.

I think 5 points is most likely, but as the minimum for any offence is 3 it’s acedemic between 3 and 5 as one conviction or fixed penalty will trigger revocation.
