Blue Badge Contravention 01, Think I set the incorrect time.....

Hi everyone,

I received a PCN today for a contravention 01. The council have not uploaded their photos yet but I am 99.0% sure that I had the incorrect time displayed on my blue badge clock. I am double gutted as I clearly remember setting it to what I thought was the correct time. 12pm but it was on 2pm when I looked at it. I do suffer with cognitive impairment and I was desperate to use the toilet which is also something I am being treated for by a specialist.

What do you think would be the best route to take please? Thanks in advance.....

Just seen the photos and the clock is between 1 and 2 which looks like 12 so I can see why I made the mistake as I arrived at 12 sad.gif

You can ask for discretion - we would always suggest this for BB holders.

Depends on council - which is it?

Post the PCN and council pics. Put pics on https://imgbb.com or such like.

I am guessing that Lewisham must be one of the tougher councils as I am able to find many other council's discretionary parking guidance notes but not theirs.....

yes I don't think we've seen a policy doc from Lewisham. This should not stop you making a polite challenge for an honest mistake. Was it on the yellow line here:

Of course we have Lewisham's policy, we have (or are in the process of getting) all council policies, see http://bit.ly/2ALghSS council policies are all in column B, Lewisham is on row 163.

Second box on page 8 of Lewisham's policy seems to fit the bill. Don't submit anything without posting a draft on here first.

Dear Sir/madam,

I am writing this letter as I would like to apologise for making a mistake with my blue badge clock when I parked my car on Monday.

You see, I had a dentist appointment so I was feeling a bit stressed. I suffer with Fibromyalgia which has many symptoms that worsen, especially when I am stressed. One of the symptoms is “brain fog” which causes a lack of attention and concentration. I was also desperate to use the toilet. I have an ongoing condition which is affecting my bladder and I am waiting on an operation date any day now. So with all this going on, I must have mistakenly thought I had positioned the clock to the correct time but I had not. I distinctly remember setting the clock before I left the car and what I think has occurred is that my brain registered the clock to read 12pm as you can see in the photo the large numbers do read 12.

I have attached a copy of my dentist appointment text reminder and a letter from my consultant showing that I suffer from Fibromyalgia and that I am waiting for bladder operation.

I hope you can understand that I made a genuine mistake and this is not something I make a habit of doing.

is this the first time you've had an incorrect clock or other issue with badge in Lewisham?

If so we'll need to work in something that points to their policy, which is that they may consider cancelling for an incorrect clock for a BB holder provided it's a first time.

I would say upfront something like:

I realise that the PCN was correctly given but I had set the clock wrong and had arrived at xxx in time for a nearby dentist appointment. This was an honest mistake and I hope that as it is the first time this has happened you will consider cancelling the PCN on this occasion.

The reason I got the clock wrong I think was....

They can. Is this the first outing for CP's efforts? Superb - and of course we need to construct a couple of stickies for the forum. When I have time I'll do a proper 'read this before posting' sticky.

OP - I checked Lewisham's policy and you were good to go with what I suggested - there's nothing more you can do really. I think they will cancel.
