I have a VW transporter, 2007. I have passed many camera vans doing 70mph on dual carriageways and everything been fine.
Now I have been issued with a conditional offer for doing 71mph on dual carriageway by way of police using a gun at the side of the road. I actually thought it was more like 68mph as I knew the camera was there due to flashing cars on the opposite side so I had looked at the speedo.....and I was behind a car in the overtaking lane. Now on my V5 its registered as diesel car, taxation class M1. I have back seats with seat belts and both side windows. Can I contest this and how do I go about it in Scotland? What is the maximum weight, if it has rear seats it is either a dual purpose (load area) or a car (no load area) which would normally use car speed limits except for a DPV which is over the max permitted GVW (3500kg from memory but I'd have to check).
Taxation class isn't, of itself, relevant at all. -------------------- There is no such thing as a law abiding motorist, just those who have been scammed and those yet to be scammed!

You'll have to approach this with care, because even if your vehicle does qualify as a DPV, the evidence still suggests that the speed limit was exceeded. 71 is below the enforcement guideline, but in theory it could be prosecuted. In England the usual approach would be to send a "bemused" letter, providing the evidence of the vehicle's DPV status (see typefish's link) and request that they drop this, perhaps citing the public policy reasons for the guidelines as well.

Now on my V5 its registered as diesel car, taxation class M1. What may be relevant is the version of the Transporter and the speed limit claimed to be exceeded - national speed limit or goods vehicle speed limit: The Passenger version - only seats, and subject to the national speed limit. The Dual Purpose Van version - subject to the national speed limit, not subject to the Goods Vehicle speed limit. The Panel Van version - which is subject to the Goods Vehicle speed limit.
