Good morning,

I received a PCN on Friday 2nd February 2018 from Euro Car Parks as the registered owner of my vehicle. I rang the garage in Bridgwater where the apparent infraction had occurred to request images. I have attached copies of the letter & images supplied. Do I need to take any action at all or should I ignore the letter? I have seen various template letters but unsure on the best course at the moment.

Do not ignore.

You put in a properly researched appeal which ECP will reject but then take it to POPLA (independent appeals service) where a properly researched appeal should win.

You are the registered keeper, there is no such thing as a registered owner.

Make sure you never divulge the drivers details on here or in the appeal, you are appealing as the keeper.

I have sent my appeal letter into Euro Car Parks as per the details below and received their response just now which I have attached. I would be very grateful for any further advice from anyone skilled in getting them off their case!

Dear Sir/Madam,

Re PCN number: 8888xxxxxxx

I am the keeper of the vehicle which received this purported 'parking charge'. There will be no admissions as to who was driving and no assumptions can be drawn. I am not liable and I believe that your signs fail the test of 'large lettering' and prominence, as established in ParkingEye Ltd v Beavis. Your unremarkable and obscure signs are in small print and the onerous terms are not readable.

Should you fail to cancel this PCN immediately, I require the following information with your template rejection:

1. Does your charge represent damages for breach of contract? Answer yes or no.
2. Please provide dated photos of the signs that you say were on site, which you contend formed a contract.
3. Please provide all photographs taken of this vehicle.

I am alarmed by your contact and I do not give you consent to process any data relating to me, or this vehicle. I deny liability and will not respond to debt collectors. You must consider this letter a Section 10 Notice under the DPA, and should you fail to respond accordingly, your company will be reported to the Information Commissioner.

I have kept proof of submission of this appeal and will also be making a formal complaint to your client landowner.

If you are a current BPA member, send me a POPLA code. If you are an IPC firm, cease and desist with all contact.

Seriously, WHY do we have to keep telling people the utterly blindingly obvious?

I tried to remove my details and repost the attachments as JPG but it took me over the 2mb limit with the earlier images despite 3 attempts to resize.

Appreciate your help if you know what to write next. Obviously you have all details if you’re one of the two who downloaded it?

I presume it’s their standard rejection, which was completely expected.

I tried to read that through before I posted in the first place. I can only apologise. Without me reading pages and pages again if someone wants to suggest I can link to OneDrive or Dropbox then I can do that no problem. In the past when I have posted on various forums I have been told not to give external links in posts.

Frankly their rejection is unlikely to be of any help or hindrance, and most likely just their normal template. Just get on with your popla appeal.

It sounded like you were able to help with the POPLA appeal based on your comment above? I’d be grateful if you were able to point me to a template or ideas what to include in it? I’ve never had a parking ticket in 20 years.

Hello,

I submitted a POPLA appeal which ECP have responded to as per the link below. Please can anyone advise how I should respond now? I basically said in my appeal to POPLA that the signs were too high and too small for any reasonable person to be able to see clearly.

I did not deny that I was the driver. I simply confirmed that I am the registered keeper and no admission of being the driver could be inferred. I have edited the name to Registered Keeper in the file below and removed ticket number, Reg, address, etc.

Did you detail how pofa was not complied with?
If so, ecp hasn’t directly rebutted this. They’ve just stated it is pofa compliant.

Go through your appeal. Anything they did not directly rebut, you point out this means they acdpt the point and your appeal must be upheld. Go through their evidence - is it for the same car park? Etc.
