Makes a good read.... Headline is that 27,000 motorists should be receiving less hassle than they would have been (over 1/3 of the 67,000 total appeals).

Including the No Contests it's closer to 50%

What is interesting is that there are several operators with an appeal success rate of well over 90%
If it's more than 60%, the BPA should be looking at sanctions

Unfortunately, as we know but the DVLA consistently says to the contrary, the BPA doesn't regulate its members

Note that the grace period to read signs at the start of parking has been removed from the Code of Practice
Interesting that POPLA says that trivial registration numbers shouldn't be punished
That needs to be stated in all appeals where this is an issue, including the appeals to the Operator

The low success rate for Premier Park is a reflection of the effort they put into evidence packs
Wonder what the success rate would be if POPLA actually examined the provenance of its landowner witness statements

The other part of interest is the appendix for Byelaws appeals, a must read for anyone writing a POPLA appeal.

As an example I am the RK for my wife's car but not the owner and can evidence that via the insurance cert' where it says the insured is the owner and I'm a mere named driver.

I did have a read and it didn't shed any light on what a Byelaw Penalty Notice actually is - a debt owed by the owner or an offer to avoid prosecution

It also fails to address the Indigo situation that the most common reason for issue isn't a byelaw offence

It's still progress that POPLA looks at them at all and provides a relatively easy way to time out the prosecutions

I agree they’ve fudged the byelaw penalty aspect, in reality the statute is meaningless junk but it does allow them to ‘offer’ a penalty, what happens if you refuse is the issue. In addition there is no mechanism for an owner to transfer it to a keeper (such as hire or lease cars) it doesn’t specify an appeal or resolution in case of dispute route or any of the other issues we know about. The benefit here is they have to offer POPLA which is a sure fire extra 2 months delay.

There's a recent Indigo thread where Indigo has provided ITAL (Independent Transport Associates Ltd) as the second stage appeal
ITAL is a member of the BPA

The organisation normally, however, deals with the appeals and enforcement of penalty fares

Can't see how it would be any different if Indigo told motorists to make second stage appeals to ZZPS

I understood where ITAL was offered its a second stage and then goes to POPLA, Indigo MUST now offer POPLA at some point.
