Bus Lane Violation - Aberdeen - Wrong Address

Hi folks,

My girlfriend moved up to Aberdeen a couple of months ago, and updated everything except her V5, which she forgot.
Basically, in December, she crossed the solid line into a variable bus lane.

A letter was sent to her previous address, and was forwarded and arrived today, 5 weeks after the council sent it out. That's the first of her knowing about it.
I believe the fine is £90 now, whether or not the council are in the process of moving it to collections just now.
I read on another forum to fill in a PE2 and PE3 form. State that the DVLA registered address was incorrect?

I've contacted Aberdeen county court to ask about getting the above documents sworn by an officer.

We're not trying to get out the fine. Evidence clearly shows the violation. Just trying to see if we can basically reset the clock of the fine.

Is there any advice for us aside from these steps?

IIRC there is no application made to the court in Scotland in order to enforce the penalty, the council can move it straight to the sheriff. I think a phone call to the council and if they wont accept an out of time representation
then pay the £90 to them before costs escalate.

If the will allow you to make reps out of time post the docs if available the video or photos for advice on any representations

This is correct. A charge certificate goes straight to the Sheriffs Officers for enforcement, like unpaid council tax.

Even in England, where things go through the TEC before enforcement, failure to update your V5C isn't looked upon kindly.

If you can't get hold of someone nice at the council and ask them to reset the PCN, it's going to cost you £90. Being nice to them when you phone goes a long way.

Thanks folks.

Did as you said. Phoned up and nicely asked about resetting the time due to wrong address.
Guy on other side very helpful, reset it straight away with the 14 days notice for £30.

Simplest way is sometimes the best!
