FightBack Forums _ The Flame Pit _ Dangerous Driving - Overtaking

Hi all, I think I have made my first big driving mistake this evening.

I was driving on country roads behind a large 4 x 4 going approx 40, when I got to a straight stretch with dashed lines my side and no instructions not to slow I indicated and started to overtake. Now when I did this I feel that the other driver sped up to stop my manevoure, by this point another car had started coming towards me but I was too far into the overtake to drop back so I sped up and got in front. It wasn’t a major close call with the oncoming car but enough to make me think that was a bit close The car now behind me started to flash and beep at me. I overtook another car shortly after with no issues on a very wide stretch of road

I am worried that I am going to get an NIP for dangerous driving, but would hope it would come down to more careless driving if it even came to something. Can anyone comment? I have no previous traffic offences and have been driving 4 years.

Thanks in advance

1. Next time, slow down and drop back in behind the car you're overtaking, rather than speed up and hope.
2. Chill out. There aren't police satellites observing your every move and triggering the issue of NIPs every time someone does something stupid - if there were Royal Mail would be in rude financial health rather than a basket case, and the government could scrap income tax entirely.

Pretty unlikely. It would need one or other of the driver you overtook or the approaching one to

Pretty unlikely. It would need one or other of the driver you overtook or the approaching one to
  • feel it warranted more than the flashing of lights and a bit of swearing
  • manage to get your VRN at the time, or
  • have dashcam footage clear enough to get it
  • then be bothered to report it
  • be taken seriously enough by the police to act on it.

Thankyou for that, when it’s put like that it does sound unlikely. Going to stop stressing about it and wait for the 14 days. Just out of interest, is it more dangerous or careless?

The general consensus is that a NIP doesn't have to be served within 14 days unless the police were aware of it at the time. Having said that, unless they have dash cam footage, or are able to secure an independent witness and are willing to go to Court, it is likely nothing will come from it.

Once you drive, driving slowly or what the speed should be just to avoid accident.

I don't understand what this means

I think it is "what speed would be best when overtaking"
Answer is highest that is sensible and legal.
The legal bit seems to be something that a lot more people take note of these days, often crawling past a lorry at 50mph and taking forever over it.
The sensible bit has gone out of the window.

Edit.... just looked at the thread started by Tracey005..... spam so probable the question here is as well.
