I have just received an NIP. The offfence occurred in Belfast, I was at home at the time in Glasgow with the car cited and can prove it. Everything on the NIP is correct but they must have the wrong plate or it is a clone.

I cannot nominate a driver or on the form. How should I proceed?

Why not just reply with exactly what you have done on here?
They will review the images and if the number has been read wrong they will cancel your notice.
Job done.

Just to clarify, where you were isn't relevant, where the car was is, so emphasise that the car was in Glasgow at he time. Most likely a simple plate misread.

Just send the cover letter with your explanation. If PSNI agree with you they will withdraw it.
If they say that it is your car then you can fill in the NIP and request for the driver ID by saying you and nobody else you know was driving your car at that location at that time. If you are right though, there will be no need to do that.
If they have given you a telephone number just call them.

See my thread here, almost identical circumstances.

They were quite helpful on the phone - just dont ask for evidence as that puts them off and invites court

Logically, one of the following must have happened -

(1) you were 'mistaken',
(2) somebody is driving around with your plates, or
(3) the CTO staff couldn't be bothered to do their job properly and misread/mistyped the plate.

(1) seems extremely unlikely to me, and presumably far more so to you. (3) is by far the most likely explanation, but (2) is potentially the most problematic.

In cases where the alleged offence is reasonably local and it is feasible that the time/date (or location) could simply be wrong, it is often prudent to wait until it would be too late to serve a corrected NIP within the 14 days before contacting the CTO. However, when this is not a realistic possibility I would say that the first priority would be to ascertain whether there is a real likelihood of a cloned plate and if necessary deal with that. Phone them asap explaining that you and your car are and were in Scotland and ask them to double-check the VRM.

err thats admitting that "you" were driving.

suggest:

request for the driver ID by saying neither you nor anybody you know was driving your car at that location at that time.

Which facts in any situation or problem are “essential” and what makes them “essential”? If the “essential” facts are said to depend on the principles involved, then the whole business, all too obviously, goes right around in a circle. In the light of one principle or set of principles, one bunch of facts will be the “essential” ones; in the light of another principle or set of principles, a different bunch of facts will be “essential.” In order to settle on the right facts you first have to pick your principles, although the whole point of finding the facts was to indicate which principles apply.
