Letter of Claim

Hello,

Several months I received a letter with subject:
"Notice of Debt Recovery - Unpaid Parking Charge of £160". Date of contravention is 2016.

I wrote to them by signed for delivery stating :
" I don't recognise the alleged debt, please return it to your principal"
I did not get any response.

I have no receive a letter with subject "Letter of Claim".
Essentially they would like payment within 30 days and one should respond online: https://dcblegal.co.uk/response/

Excerpts from the letter :
The amount of the debt is £160 which includes the PCN(s) and dept recovery costs. If a claim is issued, further costs will be sought, together with accruing interest at 8% above base rate per annum pursuant to s69 of The County Courts Act 1984

You attention is drawn to the Civil Procedure Rules 1998 and the Court's power to impose sanctions if you fail to pay or respond.


Any advice on how to proceed would be appreciated.

So SAR to the parking company.

Letter to DCBL requesting copies of all documents that they intend to use on court in order to narrow the issues between you as expected by the courts in the PAP

Need the original PCN issued

You need to send a Subject Access Request to obtain all the paperwork.

In your letter to DCBL tell them that while you deny any debt, you are nonetheless seeking debt advice (use those words) and you require them to place the case on hold for a minimum of 30 days.

This will give you more opportunity to line up all your ducks. Leave it until a few days before the current 30 days expire, then fire off the letter. You'll be getting nearer 60 days to prepare.

Unkomass - please note the above. You ALSO state you require the following documents .....

Thus is because the pap requires them to,provide such or explain why they can't, otherwise they can't start proceedings.

It's from DCB Legal https://dcblegal.co.uk/

They have included a link to an online "responses" form. Would you recommend that I use that or respond by post?

Never ever use their form. You can of course email them.

Not 100% sure, it dates back to 2016

Does the correspondence from DCB Legal not say who the parking company is? After all, it's them that DCB Legal are issuing the Letter Before Claim on behalf of.

And prepared the 'debt denied' letter based on the guidance from Umkomaas and nosferatu1001? The 30 days from the letter of claim is nearly up.
