Fistral Beach PCN, Overstay of 35 mins

Hi All

The RK received this PCN for an overstay of 35mins at the car park at Fistral beach.

Is there anything wrong in the issuing of it please.

Are Initial Parking litigious?

Any advise on how to go with this wouldbe very welcome.

Thank you so much for your detailed reply The Rookie, I will amend the letter.

To Sheffield Dave, the LBC is from CST Law and they say the claimant is Initial Parking Ltd, and that they have been instructed by IP to commence legal action to recover the amount of £170, there is no breakdown of costs attached. It goes on to say that on the reverse of the letter payment options are set out, and it is to pay DRP, not IP.

So is it fake, is it not, to err on the side of caution though, I think I will follow the advice from you guys and repsond to it as if it is real.

I will try and upload the front and back of the letter and post it here.

Well it's not 'fake' as such.

It's unusual for the solicitor to ask you to pay someone other than their client but it's not unlawful, as long as DRP have IPs consent to ask CST to sent it (or more likely send it themselves with CST's agreement) it's 'legal'.

What would be questionable is if they have called it a letter before claim but are not/don't intend using it as a genuine letter before claim, but right now the sensible approach is to treat it as genuine and only raise the matter later if it becomes apparent it was not.
