QUOTE (NeverMind @ Fri, 22 Mar 2013 - 10:50) *
I hope you wore a mask while using the saw, what with your really bad asthma and all ...

I don't think you'll be getting many positive replies to this, as no one sensible is going to want to get involved in a case of criminal damage, failure to notify change of address etc etc etc on top of the car tax issues.

Troll?

Ahh Jheez no troll... im being honest. I've had the worst week.... Since the breath test arrest they must have contacted the DVLA due to my Tax and now i've been hit hard by everyone.

I just want an easy life - I simply cannot afford, Income Tax, Road Tax, N.I, Council Tax, Tax Tax Tax Tax as well as my up and coming fine - they are gangsters with ballpoint pens and we need to start sticking up for ourselves.

I was simply asking for advice on wether I am going to be safe and sound or not - or if its another thing to worry about. I did in fact start getting a tight chest but two hoots off my pump and I was fine.

I just wanted opinions - not really legal advice as such.

Sorry if I caused you any offence "NeverMind" it wasnt my intention.

I also commented on using mother's inhaler. I accept Police would not be interested, but if Mum was obtaining prescription in her name for son, then she is open to a charge of 'supplying' a POM (Class 2 or 3 drug). Whether CPS would be interested, I doubt it, little old ladies swap medication frequently.

You can now buy some inhalers without prescription at Asda so I suspect this may not be an issue.

It's an issue here in that there is no obvious documented history of an ailment or treatment..........

Their is "Kind Of" from a young age - it is on my medical records some where - its just if NHS has got these still?

I had it on my records since young and my condition has more or less been the same ever since - how can the magistrate say "yes or no" to this condition dissapearing? Its a bit silly really.

But in any case - This forum has been really helpful and i thank everyone who has replied / commented - greatly appreciated.

I guess it seems im going to be a foot soldier or a bus wancker for a year or so sad.gif

Sucks!

In any case, I know of at least one person (ie me) who did grow out of it!

Make that two, my daughter used to suffer when in her pre-teens but hasn't had a recurrance for years.

make that 3. I also had this condition (infant asthma) left me when I was about 14.

I also think that you may be on a hiding to nothing but if what you say is true and you had not had a drink then you have no alternative but to fight it.

I dont think taking an inhaler prescribed for your mother or your mother supplying it to you constitutes an enormous offence as one poster would have you believe but it is not going to help your case much Im afraid. I would have a good HONEST talk to a solicitor and see if he thinks your story would stand a chance and if he doesnt then maybe representing yourself would save you some cash or just put in a G plea and move on.

But this whole system is flawed because I am a geuninely innocent person between us here on this forums and im bascially going to be found G!

What the hell?!

I Will do my best and let you all know the outcome so that other people can benefit in the future from this thread - any more advice would be great and i'd like to thank everyone so far smile.gif

The ONLY time "I Believe" when you CAN drive without a VALID MOT is TO OR FROM the Test Station where your MOT is to be carried out.

If you get pulled over you MUST HAVE proof of this - i.e. written evidence

If not give the police the phone number and let them do the talking themself - they will soon find you were booked in yesturday etc.. etc..

"If you are taking the vehicle to an MOT testing station for the purposes of having a test carried out when you are stopped then you may be able to avoid being convicted provided that you can show that it was “by previous arrangement”. However, you should note that even if the test centre is one which does not require that a test be booked, you may still be found guilty if you cannot show a “previous arrangement” – that is to say that you have contacted the test centre and made arrangements to bring the vehicle in for testing at a particular time"

So,

If the cameras in the custody suite does not show the officers taking me to the main machine - NOT EVEN ONCE - as well as them man handling me in such an unncessary way making the asthma even worse AND them not even willing to give me oxygen or any over medical help other than asking "whats wrong" over a 100 times ANDDDDD me taking to court a prescription from a qualified doctor giving me the asthma medication which you would be able to get hold of without asthma - would this help me in being found not guilty.

I'd also have a half decent solicitor and no previous convictions ever....

P.S BTW is their sound on these cameras?

Hi,

When you have asthma, you have it for life.

So having this as a child wouldnt change any facts - if their was a cure for it i'd be jumping for joy.

The officer "Cant have" believed me as he went straight for the Charge.

I did ask for the prescribed medicine which is the blue pump but as the police couldnt prescribe this they could have 1) called me a doctor / ambulance etc.. 2) put me on a nebulizer which would give me more oxygen to help me breath

But if i get "prescribed" these meds - which I know I will doesnt this put the whole situation "IN THE BAG" as to speak.

Its as if the police and magistrates are in it together and are very luctant to believe anyone but each other.

Hi Curious, Thanks for your insite.

It wasnt from a pub it was from a his house back to mine, I was simply picking him and he was drunk when I picked him up

For this short journey an ashthma pump wouldnt have been neccassarily as its a 2 minute drive.

If a medical expert says my chest isnt fantastic would I get a slight chance in showing the judge I am not fooling around here?

Haha!! of cause I wont ask for that charge....

So as no previous convictions ever - if I do get found guilty - am I looking at 12 months ban and £500 fine?

You haven't said whether or not your were drinking (unless I've missed it)... were you? Would you have failed the breath test if you were able to take it?

Hi,

I hadnt been drinking but my passenger had been thats probably why they thought I had been and "Smelt" Alcohol.

They choose which laws they follow? Why did they ignore the speed?

It doesnt help about the asthma pumps - but after 3 pumps or so im fine for a while - I have to use my pump about 2 / 3 times a day.

Their is a medical background in the past of me suffering asthma, As I was in their care that evening wouldnt it be right for them to have supplied me with the right breathing apparatus to breath correctly?

The cameras will show me puffing and panting furiously to try and gain some breath - they had no regard for my health at all and were ONLY interested in the conviction and not the fact i was struggling to breath and red in the face.

I can go to the doctors and they will definitely prescribe me with a blue pump straight away. I can also go to the NHS ans dig out the old records showing this history.

I think you're missing the point - I had mumps when I was 8..............I haven't got it now. Asthma and its seriousness is not necessarily a lifelong condition so having had not treatment or medication for 8-9 years will make it hard to establish as a causal factor when breathalised?.......

90% of men dont go to the hospital unless they are dieing, if they can get by they will - but if i would have known this would have happened i would of made sure i went to the hospital / doctors on a weekly basis just so its recorded.

So i have no hope in hell - Great! I hate police....
