Hi all , Ive done a bit of research on the JLA PCN A lot of the letters are quite old and I was wondering if eveything is still the same as the post from 2013-14-15-16 ie has anything changed which gives VCS more power ., Does anyone know if any new laws etc have been past at all . A lot of what Ive read relate to bylaws ??? I have until the 30th to get an appeal in or do I just simply send them a letter saying I never agreed to the terms and conditions they are saying I breached . .

Hi Folks , So it has finally arrived "Letter Of Claim" From BW Legal along with Pre Action Protocol. My Question is do I Fill it in and send it back or still do nothing as I have since my first initial contact with VCS after the said offence in Nov 16 expaining why i dont owe the debt. I Am also thinking of contacting DVLA asking on what grounds VCS obtained my details . Any help would be much appreciated.

Just had a look at websters post and the PAP is exactly the same as this , Annex 1 information sheet and reply form only, Do they need to send out all 17 pages to comply with the new PAP 01/10/17

They have to send out full details of their claim, just go to the MSE forum and use the long “crap lba” response, checking it applies.

I’m starting to wonder whether this is the commencement of a strategy similar to that of CEL. Issue enough claims, those that ignore proceed to default CCJs, those who invest the time and effort to produce a credible defence will see a discontinuation, but still taken right up to the wire, to test who blinks first.

If formal court papers are issued, a solid counterclaim will establish their resolve - and legitimacy!

It's quite possible that it's a low cost, high pressure debt collection tactic
The Particulars of Claim in the other thread look like a template that only requires the insertion of details in a couple of sentences.

It only needs about one in four targets to pay up when the court papers arrive to make the exercise profitable

I'm helping somebody who could counter-claim for harassment if BWL push their luck
VCS and BWL have been told several times that they know he has no liability because the photographs show a female driver that clearly isn't himself

at present , maybe 50% pay up not knowing , with letters before court action and posabley paying £25 to issue a court claim , £27.50 (£25 + 50p template letter) may just raise the 50% to a lucrative 80-90%

as there is one other case reported on this forum , which is far in advance of this one , it also has forum/BMPA backing , lets see if they push this or just back down when challenged

What do you think the chances would be if VCS reckon they know who the driver was ? . I made a stupid mistake back in Nov 16. I said that I didnt see any signs probably because of the weather it was Dark, Misty, and Torrential rain . Any thoughts on which way to persue this .

the BPMA have suggested that if you have named yourself (removing POFa) then to pay up


however POFa does not apply on this land


maybe they know something we dont , maybe they dont wont a fight

who knows , they have suggested that they are not interested and to use help from this forum

If the driver has been named then PoFA is irrelevant regardless of the status of the land.

however the status of the land is? this is a case of trespassing (not parking) , ie doing things not allowed by the notice boards etc , as such it should be JLA bringing this charge NOT VCS
