We dont know who the operator is, appeals go to POPLA or IAS after you appeal to the oeprator, and there is no truly independent body apart from court

Ask them under what legal basis the keeper remains liable, as POFA was the only mechanism open to them and they have helpfully confirmed that they are not using POFA.
You require alink to the exact statute law they are making this claim under

A refusal to respond will result in a complaint to the DVLA that there is no reasonable cause to continue processing keeper information, and the keeper is being misled by you as to the legal basis for you asserting they have liabiltiy. You will also complain to the BPA.

That isnt what will piss off a judge, really
Only telling the court less than 24 hours before the hearing date seemed to annoy one judge in another thread. But they could be entirely sanguine about it

If they dont pay the hearing fee then you may need to stump up the money for a hearing on costs.

Presumably the registration was entered correctly? Could be a misread on the way in as well

I would simply respond, with receipts for the parking, stating that this charge is unwarranted and must be cancelled. Parking was paid for, and made no mention of any third party company, and as such Highview have no standing.
Suggest they cancel, otherwise with the help of MSE and pepipoo POPLA will tell Highview to cancel it anyway.

There is only a single template appeal, on the MSE newbies thread. Howveer you can work out which appeal to use, if there were two different ones, anywa - as you know whether they are BPA or IPC!

THe contract, if any, is with the driver
They have no idea who drove the vehicle.
All the know is the identity of the person KEEPING the vehicle. A different person, legally and potentially in actual real world (after all, if you lease a car the lease company is the RK, but never the driver)
IF you were not the driver, then you state yu were not the driver. If you cannot say this, then you just state the drivers identity will not be revealed

Send to the court and claimant THREE DAYS before th hearing your
- skeleton, a simple bullet point of why their claim fails, why your defence is great, etc
- list of costs. ORdinary costs are loss of leave / pay at £95 max for a half day, mileage and parking. Then state that, as the Claimants action is clearly unreasonable - claiming they can enfore "no stopping" on a petrol forecourt is clearly ludicrous, thats the very purpose of the forecourt! - you are claiming costs under CPR27.14(2)(g), then list them. TIme to research, time to write defence. Time to gather photos, etc and write WS. All at £19 per hour.

I couldnt read those - theyre very low resolution. Tinypics at full res, otherwise I cant help.

Did you not tell them the dates you couldnt make it? As this is over 7 days you have a CHANCE but ideally the date picked is a date you said you couldnt make in your DQ. Also, when were you told of this date? IDeally you should reject very quickly if theyve made an errror.

Your WS covers anything and everything that hekpos you. If you do not include the head lease in it, you CANNOT INTRODUCE IT AT COURt.

Your response to their WS is trivial - parking is clearly a facility offered at the site, and once offered, a sign put up by a 3rd party stranger to the tenancy cannot alter this agreemeent. THe claimant is a stranger to the site, with no more rights to alter a tenants lease than any other entity. Even if they claim to be authorised by the landholder, once granted, the landholder may not derogate from that grant.

You could respond and state you will not be proviidn ghte name of the driver, and they are required to process the appeal without this information. Any attempt to require this will result in a complaint to the ATA and DVLA, seeking to have your access to the keeper DB barred.

C) no such thing exists
There is teh defence, and thsts THE defence, that was filed with the court ages back. No need to reserve this - it was sent to the claimant already

You may be thinking of a skeleton ARGUMENT - this is *optional* and is sent so it arrives at the court AND claiamnt about 3 days before hte hearing date. This is a BULLET list summarising the defence, how the claimants claim fails - rebutting their no doubt shoddy WS and bundlle - and can also havea costs schedule attached.

OF COURSE all documents are served on both parties - it specifically states this, with zero ambiguity, on the court paperwork.

2) Henryhippos one is good. However remember a WS is a series of facts, from the view point of the person writing (so first person "I")
3) Focus on this one
4) Not likely to be a problem. Courts seem to let them get away with this.
