Also on the NIP it say towards Shipley, I was travelling towards Bradford away from Shipley, it was evening time with some sun glare

The direction thing will not help, since it probably refers to which side of the road the mobile was located, but they can get you both ways. As long as the limit signage and traffic orders are in place, the fact you thought it was a 40 will not help. So can you go back and check the signs when the limit become 30?

Whatever happens, your spouse needs to name you and you will eventually get a notice in your name. 38 in 30 should result in a speed awareness course, unless you have attended one in the last few years.
