PCN for non-display of permit, but permit was showing

Hi there,

This matter concerns Southampton City Council.

This morning my car was given a PCN. I looked at the paperwork and the reason states "Contravention code: 12" and "Parked in residents or shared use parking space without clearly displaying a valid permit".

However, there are two important things to note:
  • My parking permit is clearly displayed
  • The rear wheel of my car was parked on a double yellow line.

I logged into the website using my PCN number and saw the photos and PCN information. The photos clearly show - and in fact make a point of showing - my rear wheel on the double yellow line. It also shows a close up of my valid parking permit.

I can only assume that when the parking inspector entered the reason, he selected the wrong one.

Is it worth appealing this, given my rear wheel was on the double yellow? I'm definitely in the clear as far as the reason on the ticket goes, but if the response from them will just be to change the reason, I won't bother.

Forget the yellow line - a code 12 is nothing to do with that.

Sounds like wrong contravention and a winner for you. If you want us to confirm post the PCN and council pics.

Are you sure the permit is OK?

Put pics on https://imgbb.com or such like.

Well worth appealing. They cannot reissue the PCN with a revised contravention for the DYLs.

Do be careful with DYLs in future. With a wheel on them you are bang-to-rights.

Permit is definitely okay, and valid to September 2020 (the photos show this).

Well it seems a solid wrong contravention.

I would send a simple challenge:

Dear parking,

I was puzzled to receive PCN no xxxxxx for the contravention, "Parked in residents or shared use parking space without clearly displaying a valid permit". A valid permit was clearly on display, as evidenced by the picture your CEO took. It is a zone Z1 permit that expires on 30/9/2020.

I enclose the picture your CEO took and trust you will cancel this PCN.

I am assuming that you were parked (mostly) within a Z1 permit bay?

I see DD put the key question.....

Where is the photo of the sign displaying the restriction which applied and what is that restriction??

So far it's all been taken on trust that the bay was Z1, but we have not seen this neither has the OP referred to it other than by implication.

And as we don't have a location we cannot look for ourselves!

They also did not take a photo of the sign in place showing the restriction, on which the PCN is based. My guess is that the CEO made a basic error and they should simply cancel.

I feel certain the permit is valid for the place I parked, as it's right outside my house and I have a resident's permit.

Are all the other signs on the road the same, or do any say "resident permit holders only"?

We'll find out if the council come back and tell you it is the wrong permit...…
Which would make why you were issued this permit and not been penalised before interesting.

But let's worry on that if it happens, everything points to the DYLs as the issue and finger error as the solution

The sign on the opposite side of the road is different as that allows non-permit parking for a 2 hours.



I am inclined to agree that this is a case of the wrong PCN reason.

Depending on how long you've been there I expect you would have found out by now if you'd be displaying the wrong permit. But now we've put doubt in your mind...

For the first sign you've shown '12' would be the wrong contravention anyway.
