Right, received the following NOR back from the council. The pictures actually prove that I entered the space at 12:02:13 (1st pic) and moved again at 12:03:17 (4th pic). If you look carefully, you can also see the blue no parking sign to the right of the white van on the 4th picture. This sign is obviously not visible when approaching the space from behind the van. No yellow lines and the open space looks like a parking spot (OK, it is marked with white dotted lines but I didn't notice them. Real nice money spinner this must be for them!

Herewith my first draft, any comments/suggestions welcome!

I wish to appeal PCN number xxxxxxxx on the following grounds.

1. Due to a white van parked behind me (as seen on the photo evidence) the “No Parking” sign wasn't visible to me when I approach the open space where I parked from Leytonstone station's end of Church Lane.

2. I parked the car and went into the butchers shop across the road. I asked the butcher immediately if I was allowed to park there. He said that I wasn't and I immediately went out where I saw the sign that was obstructed by the white van. I moved my car immediately when I realised I wasn't allowed to park there and wasn't parked in that space for more than a minute. I welcome you to view the video evidence in support of my claim. I moved the vehicle as soon as the sign was visible to me.

3.The Penalty Charge Notice description is wrong as I should have been charged for parking on the pavement.

4. The Penalty Charge Notice relates a parking contravention so CCTV should only be used if normal enforcement isn't practical. There is no credible reason for the London Borough of Waltham Forest to use CCTV on place of a Civil Enforcement Officer. There are many different types of parking restriction within a 100 metre radius of Church Lane, London E11 and the deployment of CEO's in the area would have a positive impact on keeping traffic moving and avoidance of parking offences. Enforcement authorities should regularly remind themselves of the Secretary of State's Guidance and ensure that the use of the CCTV enforcement is properly supporting their transport objectives and that it is being applied fairly and with integrity.

5. The CCTV still images on the PCN do not show the parking bay markings and therefore do not prove that the offence took place as stated on the Penalty Charge Notice.

6. Despite spending time looking in the area there are no signs warning about the use of CCTV for Parking enforcement in the area.

7. It is not appropriate to combine the PCN with the Notice to Owner (NTO). the NTO should be issued only after the PCN has not been paid within 28 days.

I take it I can appeal on the grounds that I wasn't parked in a loading bay (i.e. on the pavement)? Am I correct? Can they still fine me for pavement parking?

The PCN says - "02 - Parked or loading/unloading in a restricted street where waiting and loading/unloading restrictions are in force"

I parked just outside these parking bays on the pavement, didn't see the bays or the sign as they were obstructed by a parked van. There's no single yellow line, see pics taken from another post referenced at the start of the tread:

Is your argument strong enough to launch an appeal?

Other than that, do I have any other grounds for appeal, i.e. I wasn't parked for longer than a minute and moved the car as soon as I realised I was parked illegally, and in addition to this the no parking sign was obscured by the van behind me?

What's really annoying, is that I wasn't even parked illegally for more than 1 minute. I popped into the shop across the road and immediately asked the butcher if I could park there as I didn't see any signs. Turned out there was one, but it was obstructed by the parked van behind me. The butcher said NO, so I ran back, and parked in a legal vacant spot behind the van on the picture. Popped back into the butcher's, did my business and was gone less than 5 minutes later.

Do I have grounds for appeal because:

1) I wasn't parked illegally for more than a minute, I moved my car as soon as I realised I couldn't park there. The times on the pictures on the PCN show 12:02:33 and 12:03:06 respectively. Is there not a minimum observation time required?

2) The 'No Parking' sign was obstructed by the parked van as I went to park.
