I've just received an invoice from my lease company for £68.90 (plus £30 admin) for "Failure to pay road toll" on the M6 7 months ago.
I struggled to find any sort of dispute process so have sent a message through the m6toll site, could you give me an idea of the chances of seeing any money back and best way to do it? Event: I drove through the tag lane (I own a valid tag which was fitted), the barriers were already in the raised position and my tag did not beep as I went through. Down sides: If tags are linked to a particular vehicle, then it would not match the fined car due to it being changed since first registering the tag. Since changing vehicles the tag has failed to work and required intervention from the attendant (I am now assuming this is due to the change of vehicle), but as the barriers were up this time I just sailed through. Tag registered in my name to an old vehicle and old address. Is that enough of a case or should I put it down to a life lesson? |

I don't have a letter from the toll company, just an invoice from the lease company showing that they have paid a fine on my behalf.
It is possible the lease company did forwarded it at some point and it went in the bin. I get a monthly invoice from them each month so only open their letters if it looks different to normal. |

To find out if a tag is associated with a particular vehicle, I would ask customer services on 03306600790 but since you say "Tag registered in my name to an old vehicle and old address." it sounds as though it is. They may be concerned about people using a car tag on an HGV.
As your tag was no longer working it would not register and you may have been noted driving through the open barrier. If you can use the tag on any vehicle they should cancel the charge if you query it, but as you say it is registered to your old vehicle, it sounds as though you cannot. Obviously you need to update your address with them and probably your vehicle as well. -------------------- |

So it sounds like the lease company paid the penalty charge and have now asked you to reimburse them (possibly with an admin fee on top).
If so that would leave you no normal recourse to challenge the original penalty as the matter is now closed by that payment. The lease company isn't "fleetclaims UK" is it, they are total bar stewards for paying penalties where they should just provide the contact details for the person leasing the vehicle. It's likely this wasn't a 'fine' but a civil charge, you should ask the lease company for a copy of the original. Lease company is Hitachi Capital, I'll request a copy of the original and try to speak with someone at the toll company.

I'd also check your lease agreement to see what charges you agreed (by signing) they could and could not pay on your behalf. Ask the lease company for a copy of the paperwork they received.
