Hi,
Unrelated to my other recent post; my other half has had a rental car, booked by employer, dropped off by Hertz at our home. The rental was booked for 7am this morning, but it was dropped off yesterday at ~midday. It then had a windshield PCN attached at ~3pm. There's no argument that the car was parked where it ought not to be, but my other half has already contacted both Hertz and her employer about the matter for them both to say that it's my other half's responsibility. Hertz have claimed that they have an 8 working-hour window ahead of the start of the rental in which they can/will drop off the vehicle and that it is the responsibility of the hirer to pay for parking etc. We have no evidence of this as of yet, but either way, the vehicle was parked on the side of the road that is marked as permit holder only, rather than the other half of the street which is pay and display, and which our visitor permits could have covered. The paperwork posted through the door does include the first name of the member of staff that prepared/delivered the car. If this were a private ticket my instinct would be to name the driver, but I believe this wouldn't work with a council ticket? The employer have said (along the lines of) "oh yeah, that's annoying, at least we know for the future. You should have thought about when they might want to deliver it and told us there were parking restrictions" I don't believe my other half has signed up to and T's and C's with the employer for vehicle renting, so I would say that failing this being Hertz' problem to deal with, it should be the employers. Other half will chase the employer for any proof of this 8 hour window Hertz have (if there's no such clause in any agreement, Hertz were responsible for the car until 7am when the rental began). What else should we be thinking about? |

Uhhm.
Normally we would be asking for copies of the PCN, location, signs etc but taken it as read that the PCN is kosher and cannot be won by other means.... Owner liability allows rental company to offset this to the hirer. Whether the hire had actually started is open to question. Even if determined to be the owner for the purposes of legislation, question of whether permission could be granted prior to be notified of delivery. Also in question, who is the hirer, wife or her company. Must admit if it were me, I would simply be telling Hertz to suck it up and blame their twassock of an employee. Was anyone in when the car was dropped off? Where is your wife normally during the day?
Regardless, I agree with DD - this is down to Hertz and/or employer. They acted without due care. |

If Hertz dropped off the car early and left it in such a position that a PCN might be issued, it's their liability, fair and square. I don't buy this 8 hour window nonsense. What if you live on a red route, can Hertz just dump the car on the red lines and then demand you pay the cost of getting it out of the pound?
