Hi All
The Driver is a Driving Instructor, on the 18th December the driver parked in the carpark of some student accommodation to collect a new pupil they were meeting for their first lesson. They parked up, left the car to go and knock on their door, and returned to the car 5-10 minutes later (it was a big building- took them a while negotiating the lifts, stairs and finding the flat). They then received a PCN from Premier Park (being the registered keeper of the vehicle), along with a nice photo of my car (Photo from a Hand-held camera, not ANPR system) 1-2 weeks later, of which they ignored (bad move, maybe?) I then received another notice today, "Final Reminder". Lots of Red, bold writing and threats of court action and CCJ's in a bid to try and scare them. It says this is the second reminder they've sent, however they have not received anything else but the initial PCN. They're asking for £115 (it was initially £60 so it's almost doubled apparently) which they are absolutely unprepared to pay, and they've said they'll gladly go to court if it comes to it. The driver is a a self employed individual and was collecting a customer at an address they had been given, just trying to go about their business. There was no alternative parking around. It seemed a perfectly normal thing to do, to park in the car park at the accommodation of which the customer lives. The "Issue date and time" is completely wrong. They've put it as 22:20 on 19th December 2018. In actual fact it was the 18th December at approximately 8:30, roughly. In the photo of the car it is broad daylight which immediately proves they've got the time wrong. Is this a significant error? I've also logged into their online system and found that they took 21 photos of the car, including Inside it? Is that normal practice, to take photos of the interior? The number of photos they've taken they could almost use them to put up a listing and sell the car on Autotrader. Any advice would be much appreciated. They have not made any contact up to now so I'm looking for the best route to go, and if it involves sending a letter, some kind of template would be much appreciated . I have attached a scan of this reminder letter I have. Unfortunately I cannot for the life of me find the initial letter. I cannot for the life of me find the first letter, in the process of having an extension built and the house is upside down; because the intention was to ignore it entirely initially I didn't make much effort to keep it safe. Can I do anything without having it? You need to upload it to a free picture hosting site (imgur perhaps) and then link to it from here. Thos 2 signs side by side look as though it could be interesting.

Yes, if the time is incorrect then you can prove that you and your car were elsewhere at the time and so it could not have been you or your car.
I noticed there were 2 signs on the fence. Could we have the other one? In a consumer situation if there is a conflict in the signage you are entiteld to use the sign most advantageous to the consumer. |

Yes but I will have to go to the carpark and take my own photo of the other one, I'll do that tomorrow morning . How would I go about proving that I wasn't there at 22:20, surely it's enough that it's broad daylight in the photos which it wouldn't be at 10 o clock at night in december! |

So I've been doing some investigating..
And I believe the Entry Signs do not meet requirements (But I need confirmation as I'm not 100% sure whether I'm correct with this). The driver drove in the right hand side (no signs to advise of entry or exit). So do they have a case with poor signage? Appreciate the help so far Josh |

There was no chance they would let you post an appeal, as iut tells you quite clearly on the letter!
You just send it in writing, with proof of postage. They STILL wont accept it, but thats not ht epoint of appealing The point of appealing is to show youve cooperated and been reasonable Then, asyou will know, you look for LBA or court claim form. |
