Hi All,

I need advise on a PCN received. I parked in car park next to work and paid for 4 hours parking. it expired at 1.33pm. I was busy at work so forgot and missed all the notification. I remembered at 2.25pm and renewed it again. Unfortunately I returned to the car after work to find the the ticket. Do I have any grounds of appeal? I plan to send an email showing the payments and being honest about forgetting the time. Is there anything more I can state in the email?? Any advice will be appreciated.

So between 1.33 and 2.25 your parking was not paid for. I assume the PbP facility doesn't allow back-timing. Even if it does, the CEO would have checked using his mobile terminal and found it was unpaid and would have correctly issued the PCN.

If your later payment took the time from expiry of the first session, it will be worth submitting reps but this will be based on mitigation, and they may decide to not cancel.

From the receipt the new session started at 2.25pm. No chance with this apart from discretion and maybe being a long standing customer.

But OP - why didn't you buy an all day ticket?

Thank you all for taking the time to review and reply.

I get a permit through work which expired in July (work in a school). I renewed it for new school year and it’s arrived today so I was parking in the car park in the mean time. There was no option of full day. It only allows me to pay for 4 hours at a time which was a pain.

Thanks to your advices, I will go with an email explaining my circumstances and hope for a kind soul on the other end. 😅

This GSV from March says Stanley Road car park is £5 all day unless it's been changed recently - were you in this car park?

Yes, it used to be £5 but they changed it sometime in last academic year and now they don’t accept any cash.

Is there any evidence that they actually don't accept cash, as opposed to the machine simply being faulty?

So far all we know it's just a fault with the machine. Are there any other machines in the car park?

You could look at the angle that you would have paid the £5 all day fee but you were unable to do so because the machine was broken. I've done an FOI request on the machine logs.

Here's the FOI disclosure from the council:

On 21/01/2019 - Ticket roll was replaced at 09.16, (not known when the old roll had runout as the 21st was a Monday, so could have possibly been over the weekend).
On 17/09/2019 – Coin selector fault – Jammed. Engineers informed and on 23/09/2019 new coin selector fitted by Engineer.
The above times the machine was unable to take Cash Payments.

So there is an arguable case that if the machine had not been broken, you could have paid the all day charge in cash. This is at least strong mitigation.
