Hello
I was stopped after driving 80mph on the motorway in a 70mph. The officer admitted to not having the speed device calibrated, so couldn't do anything about the speed. They then went around my car checking the tyre treads, where one was below legal limit. My concerns about this is that no device was used to measure the tyre tread, only by eye (They were not a traffic officer). Photos were taken on the officers personal device, but it was dark and the artificial light from the phone would surely render the photo useless. I'm just wondering how enforceable the impending CU30 is when it comes through and when it does if I could be offered some kind of drivers awareness course in lieu of a fine and points. I have no other points or traffic offences on my license. I might also add that I followed the officer in their unmarked vehicle for around 3 minutes, approx 2.5 miles, (I have dashcam footage) where they were in the 3rd lane, and in that time overtook a grand total of 2 cars and then moved over without indicating. They said they only pulled me over because I flashed them, which I admitted to doing, as they were lane hogging. Dare I suggest they were soliciting my reaction to their lane hogging as means of entrapment. Any thoughts much appreciated. Thank you. No minor errors like that make no difference. Assuming you want to contest this, just ignore the FPN and they will start court proceedings. They have 6 months from the date of the offence, they tend to start proceedings towards the very end of the six month period so you might not get the paperwork till the last week of May or even the first week of June, depending on how quickly they post it out and how well Royal Mail is operating at the time.

Hello This afternoon I have received a conditional offer of fixed penalty - I was beginning to think by this stage they had forgotten about it. However, the registration number on the offer letter is incorrect by one character. Does this change matters? I still have the tyre in my possession. Did the Officer give you any paperwork at the time and does that show the correct reg. no? If so, I suspect that they will simply correct the documentation. However, you have the garage report and you have the tyre in your possession so you cannot lose the case. Richard |

Every successful appeal results from a wrong verdict in lower courts, with many being a failure to understand the law by those lower courts. Coombes, Gidden and Marten all spring directly to mind.

Would in this case it not be better just to call or write to the police force traffic division in question with a copy of the statement from the tyre shop and some photos of the tyres?
So they would drop the matter potentially? |

So they would drop the matter potentially? You can certainly try, but odds are they'll want this to be tested in court. They also failed to indicate, pulling in rather closely ahead of another driver, which I have recorded. You should definitely focus on the legality of your tyres rather than your opinion of their driving. For example, it’s generally accepted that you should only indicate if it will benefit other road users, so often there is no need to indicate that you are finishing an overtake and moving back over. Indeed, if you watch police drivers overtaking on a multi lane road, they will rarely indicate the end of an overtake. |
