Hi all,

I came home to find my car missing earlier today and after ringing around discovered it had been towed. I have a valid permit which I thought goes all the way down the street I was on,however there seems to be a small section reserved for 30 min only parking. The signage is poor and I think it's easy to get confused about which area is covered.

Anyway - looking at the pictures provided as evidence - none of them show my car parked directly in front of the "30 min" only sign. Will this alone be enough to get it thrown out?

Here are the pictures:

You'll need to post the PCN and all paperwork. And Google Street View.

use a site such as Imgur or Flickr for pics.

Towing a resident for this looks like a low priority to me.

As usual for this forum, please post the PCN, all sides, with PCN Number, and car details blanked out. Leave everything else in.. Your third photo shows your car is in a separate bay to the black car, as the bay markings are visible. This is poor delineation, and really should have a sign at the divide between bays indicating the restrictions to the right and left. On the other hand you are, as a motorist, expected to look out for the bay separators and also the signs, (along with the other 10 million things a motorist should know !!!). Taking this all the way will be a gamble, but we have yet to see the PCN which may contain fatal errors.

I reached the upload limit so here are the rest.

I've put an X where I parked. If you look at the street view pics directly opposite there's a sign that states permit holders can park in those bays, this is the one I've looked at after parking up. If you carry on down the rest of the streets nearby they all form part of the same zone.

It looks like its just the ones directly opposite the shop that have those limits. Seems like a very small slip up to be whacked with a £240 fine!

When you say towed do you mean impounded or relocated?

If the former that's £200 and paperwork.

EDIT - yes impounded. No brainer to take this to a adjudication as nothing more to pay.

It's Waltham Forest and a low level £40 PCN - this must be a venal, disproportionate tow as we see more often in Newham and Tower Hamlets. What is it about East London?

I don't think we have Waltham Forest's enforcement policy. Quick search reveals a thread where they didn't contest a removal:

This one was lost though after a bitter struggle and we don't know if the OP reviewed the decision:

Thank you for your time and input. When you say "take this to a adjudication as nothing more to pay." is that to appeal under the grounds of "The penalty or other charge paid to have the vehicle released exceeded the amount applicable" ?

Yes it was impounded. I only use my car every other day or so, luckily it was today or the fine could have been even larger!
