NIP Details and Circumstances
What is the name of the Constabulary? - Date of the offence: - January 2018 Date of the NIP: - 5 days after the offence Date you received the NIP: - 10 days after the offence Location of offence (exact location as it appears on the NIP: important): - A13 Kents Hill Road, Benfleet Was the NIP addressed to you? - Yes Was the NIP sent by first class post, second class or recorded delivery? - Not known If your are not the Registered Keeper, what is your relationship to the vehicle? - How many current points do you have? - 6 Provide a description of events (if you know what happened) telling us as much about the incident as possible - some things that may seem trivial to you may be important, so don't leave anything out. Please do not post personal details for obvious reasons - Turns out that they have converted a red light camera to a speed one at this location. There are no speeding camera signs... just the old 'Traffic Signal Cameras' one. I actually got pinged by the same camera the week before, but just accepted the NIP and 3 points without much thought. I'm now thinking 6 points in quick succession from a camera without identification is a little harsh... NIP Wizard Responses These were the responses used by the Wizard to arrive at its recommendation: Have you received a NIP? - Yes Are you the Registered Keeper of the vehicle concerned (is your name and address on the V5/V5C)? - Yes Did the first NIP arrive within 14 days? - Yes Although you are the Registered Keeper, were you also the keeper of the vehicle concerned (the person normally responsible for it) at the time of the alleged offence? - Yes Were you driving? - Yes Which country did the alleged offence take place in? - England NIP Wizard Recommendation Based on these responses the Wizard suggested that this course of action should be considered:

Afraid there is no requirement to have camera warning signs.

I'm now thinking 6 points in quick succession from a camera without identification is a little harsh...[/b] Legally, you don't appear to have any legs to stand on. There's no requirement to give speeding motorists any warning of enforcement. It's an extremely long shot but I presume you were clocked the second time before being made aware of the first incident? If so, you could appeal to their better side that you didn't have the opportunity to adjust your behavior. But they may simply point out the limit is signed correctly so no such warning is required. Hopefully there's no more as others have been caught out and having faced totting bans. A course will be offered if you qualify. Thanks for the speedy replies... much appreciated.
Regular journey for me and figured out I actually sped up (a little) through the lights so that I didn't get the red light flash... Behaviour changed, and I'll accept my punishment. |
