No, you WERE speeding.

You cannot appeal a NIP. Once you return it, nominating yourself, you’ll get a cofp offer, which you can decline and gi to court. However you don’t appear to have a defence - as was pointed out to you - meaning you can only go guilty unless you want a bill approaching a grand. Still the same three points if you go guilty, but a bill more than double.

They made no effort to match the payment, and the requirement for a full vrm has no legitimate purpose.

Popla won’t accept that as an argument however

Are you certain that they’ve copied with pofa? As you were not the driver you can state that.

No prizes for being early. Especially as you know you have to rebut the operators evidence, assuming they contest !

If you’ve got the right para in about hirer liability, then you’re good to go. Sorry popla appeals have gotten longer than my Sleep deprived brain cannmanage right now

Parking eye did you a favour - they didn’t have to treat it as an appeal. The wp bit is stupid as well - you now cannot show court you’ve appealed.

So to be clear, the notice to hirer you got says pe were supplied a copy of the agreement? It does not say pe have supplied YOU with same? If so easy pofa fail.
Loads for you to choose from in term of appeals. Pretty sure the front page alone has some hirer appeals.

1a no idea why you have pcn and particulars of claim here ?

Were the particulars served 5 days later than the 14 days allowed after the claim form? Or have you found one where particulars were served late and assumed this had to fit, and you’ve confused the two?

Pcn - the Parking notice , or “invoice”
Particulars of claim - have a look at your claim form, you’ll notice a box there called that. Does it say full particulars are to follow?

So your section 1 is confused. Totally. Based on your first post, your pcn was isssued too late too hold the keeper liable.

No part can do so. The owner maybe but this would be ultra vires, as the byelaws can only control conduct on the land in question.

If they parked on a road, it is NOT relevant land as roads accessible to the public are under statutory control in the form of the road traffic enactments. As such a keeper CANNOT be liable. In addition of all they said was “uni of Leeds “ that’s vague locus, failing entirely to meet pofa and so again, no keeper liability

They’re just letters with red ink and usually one or two lies. But no substance. They cannot do anything to you

As I said, that looks like a rejection. So BPA complaint.

Send them proof of payment, date, and reference both tha5 and issue date to show you were within the early payment deadline. I assume you can do all that?

Op to be clear here

At no point does anyone ever identify the driver.
They are their own legal concept, different from the concept of the keeper. Even if they are the same person, the ppc doesn’t know this and no one tells them. We don’t know this, and we don’t want to know!

This is why we’re saying THE KEEPER must do EVERYTHING
