The FPN sets out the options and whether you or I like them, that's what they are.

I can tell that you're frustrated, but you're dealing with a pretty inflexible process and, whatever your view, you were parked where you were not permitted because you were not displaying a valid disc.

Write to whoever, but don't miss the payment deadline because the downside is significant.

No I won't miss the deadline......but you're right it is extremely frustrating...!!.

Not necessary to post a photo of the FPN.

The reason hca indicated that you should pay it is that the normal course of appeal is you pleading not guilty in a Magistrates Court or the equivalent in Scotland. Then the fine could be much worse if they don't find in your favour. So in terms of risk management it is usually better to pay up.

Some police forces allow informal appeals but only if it states so on the FPN that's why I wanted a look. Usually if this facility is on offer you have to write within 14 days of the FPN being issued. If it's not offered grit your teeth and pay up.

If you are permitted to send an appeal the signage issue is relevant.

Mick

Thanks Mick...I have the option of not paying and requesting a court hearing as long as I ask for a hearing before the 21 day payment period expires.

So I either pay up or go to court....there's no appeal option.

Just wondering if it's possible to pay and then try to get my money back....or there is an ''enquiries'' address to write to on the FPN...perhaps send a polite letter next week and see if there is a response ...?.

The policeman at the time told me all I needed was a clock disc and they could be obtained from the Town Hall which we were standing right next to...so in I went and got one for free......now why couldn't that info have been on the disc zone signs...?.

Post up the FPN. If you are a visitor the normal arrangement is that you go into one of the nearby shops and request a parking disc. I would have thought the time spent in such acquisition is legitimate grounds of appeal if the FPN was issued in the meantime.

I read the other day that 90% + of England is covered by the CPE regime but backwaters like this exist where decriminalisation of parking contraventions has not occurred.

Can you see a Wicker Man atop the nearest hill?

Mick

It was Scotland .....The Wicker Man was not in view....maybe hiding....:-).

When you say ... ''Post up the FPN''.....you mean..?

I was just wondering if the Free parking sign in the high street pointing to this car park is correct....why is there not information on it that indicates a disc is required...?.
If the sign is at fault would that not make the FPN's handed out invalid....?...or am I clutching at straws here...?..

Driving through a town yesterday I saw a blue sign with a P on it and the number 25(places available) underneath plus the word FREE with a big arrow pointing to a side street.

Needing to park I duly followed the arrow and entered the car park...I then saw signs indicating it was a disc zone car park.

Now I know I'm at fault here but I'm not at all familiar with disc zones and with the FREE parking sign I followed fresh in my mind thought that the ''no return within 2 hours'' was meant for folks who didn't have a disc to display...and if your stay was longer you needed one....

Anyway I only wanted to post a parcel so nipped round the corner to do so and literally only 5 minutes later I returned to my car to find a beaming policeman and policewoman. ''Have I done something wrong I ask''.....''yes'' I was told...''you've parked without displaying a disc'....and with that a £30 Fixed Penalty Notice was stuck to my windscreen......there were 25 places .....and car park was empty except for my car and one other...!!......the sun was shining ...but not on me that morning.

So that sign in the high street is surely misleading is it not...?.....Straight after the police left other cars were coming in and like mine had nothing displayed on their screens when I looked.

What would others do in my position....?...I know I was in the wrong....but in my book free parking is not disc zone parking....any thoughts appreciated.
