Owner of the car put my details down as I was driving at the time of the alleged offence.
Now I have received a letter. Just wondering if the loop hole in Scotland still exists. Owner has complied with section 172 can I now fill out my details and not sign? Form has changed since I last had one many years ago. Thank you |

Is there a risk that the OP gets a summons if they go down this route?
My thinking here is that the police have a possible witness to put the OP at the wheel at the time of the alleged offence (depending upon circumstances and relationship of owner to OP) Can they use the signed s172 from the owner in evidence? The OP hadn’t provided details so not sure exactly what the OP is facing if they sign the form. |

It’s possible they will get a citation, the police have nothing to suggest they have a witness (the respondee was unlikley to be sitting in the car at the time) so I see no reason it won’t follow the normal route. The PFs are known to go to citation and right up to court and then folding before the actual hearing.

Owner was not present at the time of offence therefore can not be used as witness.
Therefore I was rather hoping I could still go down the route of filling out but not signing and they not being able to take the matter further unless they report to my door. |

This doesn’t look good.

The citation IS what calls you to court, they could have just posted it anyway.

So the police do not have a citation or anything that was listed on the slip previously posted.
They are coming to the door in order to force me to sign the the form. Now where do I stand with this. Can I refuse to sign ? |

To avoid any confrontation, many people just prefer to 'be out' when the police come knocking, but they cannot force you to sign and a polite refusal is fine.
