CP Plus Lancaster Services, Break Down |

Driver stopped at Lancaster services and on coming out the car refused to start and it took nearly three hours for the breakdown services to arrive. I've received a PCN from these people. I'm the registered keeper but not the driver, and live in Scotland. Advice on procedure would be very welcome. Thanks.

If you live and car is registered in Scotland, flat out IGNORE unless you get a claim form or some form of letter before action.

Yes the breakdown can be proved, but I didnt want to engage with these people unnecessarily.

But just in case, you retain proof of breakdown. These two things are entirely capable of being carried out at the same time |

If you do want to save yourself unnecessary hassle, CP Plus cancel quite easily, especially if you have proof of the breakdown.
I have had the same situation, breakdown with proof, one letter, including proof and they cancelled. Stories of others across this forum seem to back up the fact that CP plus cancel with a reasonable explanation. I see you're in Scotland and so court would be very unlikely but CP plus rarely do court in England anyway. |

KH that's interesting, thanks. If CP Plus are one of the few reasonable outfits (are any PCC's reasonable?) I would be happy to respond to them out of courtesy with proof of breakdown (the breakdown people are sending me a letter of confirmation with times), but I don't want to reject the advice of Nosferatu and Ostell who as I know from being a regular observer of the forum also know what theyre talking about.

You may as well send by email, proof of breakdown, which is perfectly safe, a long as you DO NOT IMPLY WHO WAS DRIVING!
Write as the registered keeper and talk about the car and the driver in the third person. BE CAREFUL WITH WORDING. |

I got the breakdown company's letter today confirming the breakdown/recovery times. It identifies the driver!

You can just blank the name and address out. As long as the vehicle details are present. That way they also know you wont be identifying the driver. |

For a Scottish resident the last line of defence is the drivers identity is unknown so no court case could succeed as there is no concept of keeper liability, no point in throwing that away.
