Hi

Good morning all

A PCN was received last week addressed to lets say the registered owner of said vehicle, parked in a car park whilst went to get something to eat and see a film, the firm issuing the PCN is Vehicle Control Services Ltd. Is it needed to post up the letter ?

Thanks

Do not go near the IAS
It guarantees to reject at least 85% of appeals

All you would achieve is hand VCS an "independent" decision to wave in court if they take legal action later
As far as the court is concerned, IAS appeals are considered by solicitors and the organisation is the only one approved to deliver dispute resolution for parking under the Consumer ADR Regulation
A judge would need a very good reason to overturn its decision

You will then be the one that appears unreasonable
Putting VCS to the cost and effect of defending the IAS appeal when you had no intention of accepting the "wrong" result

It is recommended not to appeal to the IAS, they will reject, even if you have a very good case. The IAS are far from independent, it is run by the people behind the IPC and their solicitors. Wait for further action.

Ok thanks, glad I checked here.

How are they able to call themselves "Independent" when they aren't, Im surprised they are able to carry on when they aren't independent.

Ok advice has been noted.

I still can't believe they are will to go to these lengths just for a measly £60 at the moment and £100 or more later.

Some companies have taken a decision to roboclaim just about everything. Whilst they may lose some single cases the vast majority pay up to fund the process and is extremely profitable. A company that does issue a large amount of claims will encourage many to pay without a fight...

I'm surprised more companies don't abuse the court process in this way

Estimated once that it only needs one motorist out of four to cave in when the papers arrive to make a profit on the exercise

The actual number has to be closer to three out of four

According to one report (FOI?), claims by Civil Enforcement, a particular roboclaim company, have about 80% success rate
The company has never turned up to a hearing and cancels the claim if it's defended

As their claims are particularly padded out with fake charges, their claims are more likely than most companies' to be defended

There was a recent thread that looked at the numbers
The fake charges meant that motorists that don't pay up without a protest are the least profitable

According to their accounts a couple of years ago, the legal representative fees that ParkingEye added to claims for their in-house solicitor amounted to about a quarter of their running costs and made the difference between profit and loss

Note the "May". The cannot start proceedings without further notice, and probably will not anyway. They cannot just obtain a CCJ against you and the rest of it are just frighteners.

Yes its hotting up now isn't it lol.

If they do start a court claim then there will be some unexplained additions to the sum claimed.

Come back if you get a Letter before Claim.

"I'm still finding it unbelievable they could go to court over a small amount. "

The small amount times millions of tickets issued means that many small amounts become very large amounts very quickly!

VCS take cases to small claims all the time. The scam works, people pay.

...only, not here or on MSE forum!
