Purely anecdotally, when I completed accident reports I tended to tick the box that said speed was a cause of I thought a slower speed might have avoided the accident (obviously avoiding the absurdity that a stationary vehicle generally won’t cause an accident). The statistics are probably rubbish.

Let’s not forget that if insurance wasn’t in place at the time alleged by the prosecution, a subsequent decision by the insurance company that it would have met any claim doesn’t provide a defence. On that basis, the position may well be the same where the FOS orders the insurer to insure. That is, of course, a separate point to whether a prosecution remains in the public interest.

In one respect, that’s why I’m glad we’re a small bar and are thus all ‘generalists’ to some degree. Juniors often get plonked into the magistrates to get some experience, so most have done some criminal advocacy at some point in their career.
