Here are the images I was supplied by avon and somerset ( liscence plate removed from the second pic by me of course), the driver cannot be established so i think i will go down this route.

Is this the actual quality you would normally expect? seems pretty apalling to me. In the first image i do not even know which is my car, guessing the one towards the centre.

Why is there no speed or distance reading on the second image without them i cant check how fast the car was travelling. I do not believe the reading of 73mph!

Any other advice would be gratefully recieved.

Thanks crystal, i have just applied for the photographs to see if i can identify the driver.
Does anybody know if it matters that the mobile unit taking the pictures appears to be in a camera site authorised for fixed point cameras?

A46 swainswick bypass, southbound (nearside) (50 mph) (id128) is listed a fixed point camera location.

From looking at the avon and somerset website the a46 is not listed for mobile units at all.

The swainswick bypass is 3 miles (5 km ) long.

To clear up the confusion, the original NIP was addressed to my partner, so she was originally the accused, she did not recieve the NIP at all because the address was incorrect. Upon recieving the reminder she notified avon and somerset that she was not the registered keeper (this could have occured much sooner had she actually recieved the missing NIP, perhaps even within 14 days!.) 3 months after the incident I recieve an NIP and can't for the life of me remember who was driving.

Avon and Somerset appear to have looked up our address through the DVLA and come up with a garage. They have then contacted the garage and asked for the details of the new owner (since my partner paid by cheque her details were given). They have then copied down the address incorrectly as they have not checked spelling.

Is there any way around this at all or will I have to accept responsibility when I am not even sure if I was driving?

Could the photos be of much help? What would I need to look for to quash this?

Last week around approx. 15/05/06, my partner recieved a reminder regarding an NIP that was supposedly for an incident on 03/05/06. Mystified we read the reminder to discover the NIP had been sent to her instead of me, (I am the registered keeper.) I believe this is because the car was a new purchase and the DVLA had taken some time, (nearly three weeks), to update their records.

The NIP and reminder had both been sent to the wrong address, (incorrectly spelt and wrong postcode), to my partner whose name was also incorrectly spelt. The postman had somehow managed to decipher this and deliver the reminder to us yet not the preceeding NIP. It could be anywhere now!

It weould appear that the police contacted the previous keepers, (our local garage), to get the name and address of the new keeper. It would seem though that they have taken down the information incorrectly, or have been given incorrect information, hence the spelling mistakes.

My partner wrote off to Avon and Somerset constabulary stating that she was not the registered keeper and did not believe that she was driving at the time. She also stated that due to the incorrect address she had not recieved the NIP and that it was unfair for them to expect us to remember who was driving nearly 3 months ago.

Since then, Avon and somerset have rechecked with the DVLA and issued a new NIP to me (the registered keeper) at the correct address. The notice Issue date is now 17/05/06 for the offence on 03/03/06. There is also a nice letter stating that they could not with reasonable dilligence have acertained the name of the accused or the registered keeper.

My argument with them is that they did ascertain the name of the accused (my partner), but due to a lack of dilligence they did not take down the information for name and address correctly. How does this stand up?

On top of all this the incident is alledged to have taken place on A46 swainswick bypass, bath >> M4. In this area there is a camera site listed as - A46 swainswick bypass, southbound (nearside) (50 mph) (id128), however since my direction was northbound on a dual carriageway am I right in thinking that:
i) The north and southbound carriageways would be seperate camera zones.
ii) As the northbound carriageway is not listed it is not an authorised camera zone, (the site is not listed as a community concern site or a temporary site.)
??

The camera must have been a mobile camera and would appear to have taken my picture oncoming from the far side of the opposite carriageway over the central reservation, is this allowed?

I intend to order a copy of the photographs in order to ascertain who exactly was driving at the time.
