Good evening all. First time poster and possibly a tad too late but here goes !
I received an invoice from Civil Enforcement in April 2016 for overstaying in Taunton Holiday Inn car park. I appealed at the time stating poor signage positions and punitive charging etc. Appeal rejected. I then made a Popla appeal which was also rejected. I waited and heard nothing from Civil Enforcement after this at all until a letter today, nearly 2 years later, asking for £100 within 14 days or the hounds of hell shall be released on me !! Any advice as to how I should deal with this would be much appreciated. Many thanks |

You'll have to wait for them to issue the court claim and then defend. They will then discontinue when faced with a defence as they don't want to go to a hearing.

Thanks for reply. How would I go about a defence ? It was so long ago I had forgotten all about it until today and long ditched the correspondence from the time.

There's an example defence in a recent thread. CEL seem to have issued another bulk of claims...

Thanks for reply. How would I go about a defence ? It was so long ago I had forgotten all about it until today and long ditched the correspondence from the time. It doesn't matter if you've forgotten Civil Enforcement defences make hardly any mention of the driver's actions As you've now learnt, never throw away a document that even hints at the possibility of a debt or legal action until the matter is confirmed to be closed |

Indeed, we live and learn. I remember after a year had passed thinking , well that’s them gone away then , and binning all the letters.
So now I need to sit tight, not respond to the letter I have received, and wait for a court letter ? |

Wait for a letter from CEL that refers to the Pre-action Protocol for Debt Collectors
Ignore the letters from ZZPS, a debt collector and QDR/Wright Hassall, a solicitor acting as a debt collector and which doesn't issue claims |

Of course, but there's a fairly generic one in recent threads and CEL don't contest - it's all a numbers game. The CEL defences from 2017 onwards are nto at all specific. They dont really mention the drivers activities at all
CEL have so far discontinued EVERY SINGLE CLAIM we have assisted with. They do, however, make you 1) write a defence 2) write a witness statement This post has been edited by nosferatu1001: Thu, 15 Mar 2018 - 10:36 |

its a court claim form. Not a letter.

So that’s another letter from Zzps and now one from QDR Solicitors today. So just checking that the advice still stands to continue to ignore this as a “fake” solicitors letter ?
And assume next will be a court action letter soon? Thanks guys x |

Evening all. Well I have finally received a County Court claim form today. Rather unfortunate timing as I am off on holiday for 2 weeks now. So I believe my first move is to go online and acknowledge the claim. Then that gives me an extra 2 weeks to provide a defence. Do I understand that correctly ?

Right at the beginning, you mentioned appeals that had failed. Did you identify the driver in any of those appeals or other contact with CEL or their agents?
