That won't stop PE but you will, we hope, be ready and already know how to acknowledge & defend the claim already. Hopefully you have been following the advice you have had, and have been:

QUOTE
reading all the other ParkingEye defence threads in readiness...On here and on MSE:

https://forums.moneysavingexpert.com/forumdisplay.php?f=163

This is done to death and of course you can defend it. You need to prepare and read what to do (start with reading the NEWBIES thread at the top of MSE there, the second post is all about court defence stage and both forums see almost ALL fully coached/well defended cases won.

As explained 3 weeks ago.

You should have complained to the GP at the time. I can never understand why people do not do that first, why would someone have to tell you that's an option, of course it is, first port of call is the landowner/retailer or clinic, Hotel or hospital where the offending fake PCN was issued.

Wow CEL have cut back on their words on the front of that sparse piece of trash!

Show us the back, just want to be sure they haven't got compliant POFA wording about the keeper being liable.

CEL fold when they see the template appeal from the NEWBIES thread on MSE, it is that easy.

pleas delete your final sentence above the photo... do not type stuff here that says who was driving.

Makes no odds, you won't be paying. no need to cross your fingers, you might lose but so what? PP win quite a few POPLA appeals and people here just ignore them and sit tight.

Search this forum and MSE parking form, for:

POPLA lost Premier

if it happens. No coming back thinking you have to pay, if this is lost!

Did you lose at POPLA then? That doesn't look like a winning POPLA appeal. This would have been so easy to win for a registered keeper but too late for that now. Next time!

Just ignore APCOA and their tame debt collectors.

See you at Witness Statement stage, so you don't miss the stages that are important before the hearing.

QUOTE (Redivi @ Tue, 10 Jul 2018 - 12:54) *
You need to do a lot of reading about the CPMS-Mil scandal and find examples of defences because yours omits all the vital points and is next to useless

Unfair Terms in Consumer Contracts Regulations 1999 have not only been replaced but as a defence point were kicked out by the Supreme Court three years ago

This ^^^

Just copy a previous MIL defence from 2017 when we saw a few.

You need to talk about the lack of valid assignment, and the fact that the data was obtained unlawfully (assuming CPMS got the data from the DVLA and not from YOU, in an early appeal?).

Glad you added the emoji, emanresu, hopefully the OP is here enough to get the British sense of humour...

To the OP your thread has been moved to the correct forum:

http://forums.pepipoo.com/index.php?showtopic=121432

We are waiting to see the PCN, all pages:

QUOTE
Please add a photo/scan (Read the FAQ on how to) of ALL of the PCN with just your personal details redacted.

On that thread, not here...

I guess so, seeing as you threw the winning point in the bin:

I did, on the appeal it asked whether i was the driver,

I asked if we could appeal as disabled but was told you can try but wont get anyway quite rudely.

Who told you that, UKPPO? NEVER ring a parking firm scammer!

You should complain to the actual Airport about disability discrimination, and I doubt the signs differentiate about the number of seats...

Yes, the one on the left is in large letters, makes a parking offer, no fine/penalty mentioned, and threatens clamping, a criminal offence.#

The PEA one is unreadable, in terms of any 'contractual parking charge'.

Never write about 'no loss' in any reply to any parking firm. That argument went out in 2015 in the Beavis case.

So stop saying it in replies/appeals, because it shows your company don;t know what constitutes a proper defence, if you got a PCN from a litiigious firm. Luckily, G24 are not. Ignore them if there is no scope for complaining to the retailer (ALWAYS do that as Plan A, normally).

No need to post it here, just report back when it wins like this person did:

https://forums.moneysavingexpert.com/showth...d.php?t=5865458

With Highview it's best to use the MSE template as they seem to have instructed their minimum wage appeal staff/students to cancel those ones.

Honestly none of this matters (especially the date! It's a non POFA PCN so why pore over the deadline in the POFA that doesn't apply?!).

It's Highview, use the MSE template and they'll cancel:

I promise.

I am in touch with Nosferatu1001 and find him very trustworthy and knowledgeable.

No idea why you have an issue with him but that was your problem and not his, as far as it seems to me. You won, with his help and others!

This thread from MSE sums up why we don;t need any posts on either forum, about debt collectors:

https://forums.moneysavingexpert.com/showth...d.php?t=5035663

...no, not even the next letter, nor the next scarier/red one. No thanks! We really never want to see another pic of a debt letter again!

ParkingEye follows this forum and will use any information it finds

Never seen that? Not from PE. Only Excel being handed pepipoo threads out of malice (not incompetence) in a well known case.

Anyhoo, one email to Morrisons cancels this scam every time.

Search the forum for Morrisons and use the 'donotreply' email on all the other threads.

Wing have 35 days to reply, they then give only 14 days to do the 2nd stage appeal to the Council, then you get the POPLA code.

None of this matters, no Wing case should ever be lost at POPLA; you'd have to try very hard, or blab about who was driving, to lose!

Forget the CAB, most advisers have no clue about parking cases. Premier Park rarely do court, and many people lose at POPLA, and sit tight. This is normal and guess what people used to do, before POPLA existed 6 years back? Yep, they sat tight & ignored the scam.

Search this forum or MSE parking forum for 'Premier POPLA lost' and show me anyone who was been sued?!

No grace period granted: 18mins might be too much
No, if the driver paid for an hour, do they have their ticket to compare to the ANPR timings? Is it, say, 8 minutes on arrival (observation period) to read the signs & pay, then ten minutes (within the grace period) at the end?
