Evening all, need a bit of advice with this one please.
#1 son rec'd a PCN from CEL for apparently parking without entering his VRM in the terminal of our local Co-op store on 03/08/2018.
He is a very frequent visitor and cannot believe he forgot to enter his VRM.
Upon receipt of the PCN late in the week he went into the Co-op to ask why he had been targetted when he was almost certain he would have entered his details.
The supervisor said 'you probably used number 2, loads of people have been receiving them, it's faulty'. She said she would ask the management to try to get it struck off, but to hassle CEL to cancel the PCN ad they probably would.
I've just been reading on here about CEL's antics and cannot believe they are allowed to trade, it's diabolical !
So my question please is what to do next: Does he wade into conflict with CEL on a personal basis hoping they will cancel, like the woman said or does he make use of this fantastic resource to a reasonably safe solution?
We really don't know what to do for the best, if we are honest.
An interseting point (to me, the uneducated one) is that they state the address as Car Park at Sizewell Rd, when there are actually two car parks about a hundred yards apart. Obviously trying to play down the Co-op's involvement in this scam.

I thought that the Co-op ended its contract with CEL four years ago

It triggered a blizzard of claims against Co-op customers

The Co-op, in an act of sheer stupidity, paid the claims for customers that complained
As a result, CEL issued thousands more

It's on public record in the minutes of Bridgnorth Council regarding Severn Park that CEL issued parking notices knowing that a faulty key pad was producing errors

They are allowed to continue as the landowners you pay (directly or indirectly) contract them to.

Quite right, Redivi, I read a lot of that when our Co-op got into bed with them last year.
They were hammering regular customers left, right and centre.
I just can't believe they are even allowed to operate.
I read with interest the most recent 7 pager on them and how once again, they discontinued after, what, three years of harrassment?
There should be a law against their modus operandi.

Did anyone see the file I uploaded btw, as I scanned the PCN and thought Iuploaded it correctly

Is that all that you received? Was there anything on the back?

If that was all that was received then it is definitely not compliant with POFA and therefore no keeper liability.

What is the date of isse of the PCN?

The vehicle was NOT parked for the time stated. The car was moving in front of the camera and therefore, by defiinition, not parke.

When was the PCN received? They appear very close to the statutory deadline to hold RK liable.

CEL will refuse the first appeal from RK but will provide a POPLA code. A full RK appeal to POPLA will see them fold and not offer any evidence.

I've found that, for all their (many) faults, CEL is one of the few companies that will accept strong appeals rather than waste the keeper's time with an appeal to POPLA

He brought it up to show me on Saturday, so hopefully end of last week, say 16th - 18th Aug at a guess? I shall ask.

When was it issued ?

A parking notice is deemed to arrive two business days after posting, which could be the following Monday

On the dates alone that's 13 days, but deemed served 2 days after posting. No proof that it was *posted* on the 13th.

A standard keeper appeal to get a POPLA code, then a POPLA appeal should see this off.

Just to let you know that the store manager was able to cancel the ticket.
Unfortunately it just lets them carry on with their particularly easy form of extortion.

CEL may continue. They had a massive bust up with Co-op who then found that their staff were targeted.

Continue through the appeal procedure in the normal way. You probably have some deadlines coming up. What stage are you at with appealing to CEL/POPLA?

I've done nothing further as my eldest said that the store manager had got the penalty charge cancelled.
