Temple Mill Lane - No Entry, No contest at Tribunal

This is being posted in case it can help others.
Had a driver go through the no entry sign at Temple Mill Lane. Went to Tribunal. Not contested by Newham. Perhaps the cynic in me thinks that they know the signage is inadequate and don't contest if a reasonable case is put together.


The points raised for the tribunal were:


There are two main reasons why the contravention did not occur.

1. The no entry restriction is not adequately and/or lawfully signed.
The no entry sign effectively closes the road to certain traffic. There are no warning signs when entering the road informing a motorist of the restriction ahead. Furthermore, on arriving at the “No entry” sign, there is no provision to advise motorists what they must do to avoid passing the “No entry” sign, and the road is not wide enough to perform a U turn and avoid the trap. Newham Borough has a statutory duty to provide adequate warning of such a No Entry sign but have failed to do so.

2. Incorrect location.
The PCN states that the alleged incident took place in Temple Mill Lane. The cctv camera from which the footage was obtained is situated in the same road as the “no entry” sign. The still of the images on the PCN shows the location of the camera to be Temple MillS Lane. Also, the National Street Gazetteer has the road listed as Temple MillS Lane. No contravention took place on Temple Mill Lane and, therefore, the PCN is unenforceable.

We ask the Tribunal to note that information was requested from Newham Council in order to determine the veracity of their allegation. None of the following information requested has been forthcoming:

a) Evidence that the road is called Temple Mill Lane and not Temple Mills Lane.
b) Diagrams showing the layout of this No Entry, the road markings and all signage relating to the No Entry (including warnings and camera enforcement).
c) Copies of any approvals of deviations of signage from TSRGD.
d) The number of PCNs issued in the last 6 months for contravention 51j at this site.
e) Recommendations for a driver of a 7.5 tonne vehicle as to course of action to take upon approaching the No Entry for which he has been given no warning.

I received the same PCN today for Temple Mills Lane and have all the errors listed previously.
Not sure if I can still appeal
